I, JOSIAH BRINKLEY of the County of Halifax & State of North Carolina, weak in body but sound in mind, being about to pay that debt to nature which all men must sooner or later pay and being convinced of the frailty & uncertainty of life, in prospect of death do commend my soul to God, and do make in this my last Will & Testament the following disposal of those earthly goods, which he has been pleased to grant me
To wit; I lend to my wife MARY four Negroes during her life, namely, MOURNING, TOM, RAND, and BRADFORD, and one hundred acres of land adjoining JOSEPH J. GRAY on which land I want a comfortable house built. To my daughter NANCY I give & bequeath the following Negroes, to wit, ROSE, ALFRED, CAROLINE, SARAH, HENRY, AMANDA, ADELINE, PERMELIA, LUCY to her & her heirs forever. To my son JEREMIAH I give all the rest of the Negroes not heretofore given away to him and his heirs forever. Those Negroes which I lend to my wife MARY during her lifetime, I give and bequeath to my son JEREMIAH his heirs and assigns forever, after her death, I likewise give & bequeath to my son JEREMIAH the household furniture and the crop which is at present on the land. And I likewise give and bequeath to my son JEREMIAH the tract of land whereon I now live, lying on the South side of the Warrenton and Halifax Road, and two acres at the light wood stump on the North side of said road. I likewise give and bequeath to my daughter NANCY the following tract of land the tract of land whereupon she now lives called the Governor Branch tract, and the HARVEY tract on Thomas Mill Pond.

Lot No. 1 as above described was drawn by JESSE R. CLANTON and to make the division equal this Lot is entitled to receive sixty eight 33 -2/3/100 dollars from Lot No. 2 and Eight 33 -1/3/100 dollars from Lot No. 3. Lot No. 2 was drawn by ISAAC N. FAULCON Administrator of LUCY CLANTON and pays as above stated and Lot No. 3 was drawn by DUDLEY CLANTON and also pays as above stated. Given under our hands this 28th Dec 1846.
We further report that in the division of the above Negroes then were certain invalid, to wit CHARLES and NANNIE the keeping of whom was said to be worth two hundred dollars which amount is to be paid from the three Lots as above stated each Lot paying one third. The keeping of there invalid was allotted to ISAAC N. FAULCON Administrator of LUCY CLANTON and for this he is entitled to receive from JESSE R. and DUDLEY CLANTON Sixty six 66 -2/3/100 dollars each.
Given under our hands date as above 28th Dec'r 1846.

In the Name of God Amen
I, BENJAMIN W. DAVIS of Halifax County and State of North Carolina being of sound and perfect mind and memory (blessed be God) do this thirteenth of August in the year of Our Lord one thousand eight hundred and forty eight make and publish this my last Will and Testament in manner following, viz - First I give and bequeath to my beloved wife, MARGARET W. DAVIS the following Slaves, viz - STEPHEN and his wife MOLLY and their daughters EMILY, CHARITY and CAROLINE, also I give to my said wife PETER and his wife MINERVA and their eight Children viz, NELSON, WILLIAM, AMANDA, FRANCES, BETSEY, DAVID, NAPTHALI and ROBERT likewise Man viz VIRGIL and woman FANNY. I say I give and bequeath the named seventeen Slaves to my said beloved wife and her assigns forever.
Secondly I give and bequeath unto JOSEPH WEBB and her assigns forever the following Slaves viz HORTENSE and her child MARGARET, PAULINE and her child RACHEL, ROSETTA and her eight children viz JOHN, HOLLAND, DANIEL CHARLES, HOMER, PRIMUS and JANE making thirteen. All the rest and residue of my slaves not named above I hereby give and bequeath unto ANN N. DUPREE and WILSON S. DUPREE and their assigns forever to be equally divided between them the said ANN N. DUPREE and WILSON L. DUPREE, I hereby give and devise unto WILSON L. DUPREE and his heirs forever a certain parcel of land situated lying & being in this county of Halifax aforesaid and on both sides of Beaverdam Swamp estimated at Eight hundred and forty five acres of said lands I purchased of WILLIAM H. POPE and HENRY MASON. I lend unto my beloved wife MARGARET W. DAVIS all the rest & residue of my land (not given & devised as above) during her natural life and at her death it is my will & desire that said loaned land should go to ANN N. DUPREE I therefore give and devise the same to her and her heirs forever. I give and bequeath unto my nephew THOMAS K. HARRIS one thousand dollars to be paid to him (within two years from my death. I give and bequeath unto WILSON L. DUPREE two thousand and his assigns forever. Now all the rest and residue of my money and all bonds, now and judgment which I may possess or may to me belong at my death I hereby give and bequeath to my beloved wife MARGARET W. DAVIS and her assigns forever. I like give and bequeath unto my beloved wife MARGARET W. DAVIS all the rest and residue my personal property not given away above whether it be stock, corn, fodder, farming utensils household and kitchen furniture or by what ever named or denominations I made and ordain my beloved wife MARGARET W. DAVIS Executrix of this my last Will and Testament. In witness whereof I the said BENJAMIN W. DAVIS have to this my last Will and testament set my hand and seal the day and year above written.
Signed, Sealed, published and declare by the said BENJAMIN W. DAVIS the testator as his last Will and testament in the presence of as who were present at the time of signing and sealing thereof.

I, EDWARD DAVIS of the county Halifax and State of North Carolina do make and ordain this my last Will & Testament, to wit
My will & desire is and I do direct that my Executors herein after named cause to be emancipated and sent to some free State or Country as may be desired, my servants FANNY and ROSE and all the issue of them living at my death the expenses to perform which I charge on my whole estate
To the servants aforesaid when so removed over and besides the expenses of their removal I give the sum of four (4) thousand dollars to be raised out of my Estate
To my executors hereinafter named I give the whole of my estate, first to raise the money mentioned in the foregoing Items and in the second place for the use and benefit of my two daughters EMILY E. DAVIS & MARIA L. LEWTER and their children free from the controls of their present or any future husband, during the lives of my said daughters and at their death to their children or the issue of their children. The said estate so given in trust for my said two daughters to be one half to each and to be ultimately divided between their children and the issue of such children accordingly. And my executors are herein empowered and directed that should any of my slaves become unmanageable so that the interest of my estate shall so require, to sell the said slave or slaves and to hold the proceeds subject to the trust herein before declared or to buy others as may shall deem most privelent holding the same subject to the trusts aforesaid.
4th; I nominate & appoint BURWELL DUNN and MATTHEW WHITAKER both of Halifax, N. Carolina my executors to this my last Will & Testament hereby revoking all other wills by me heretofore made.
In witness of which I have hereto signed my name & published this will the 15th day of June 1849.

Whereupon BURWELL DUNN one of the Executors named in said will appeared in open court and is duly qualified thereto, ordered that he has leave to sell the perishable part of said estate upon a credit of six months.

In order that there may be no disputing about a certain paper writing purporting to be my last will & testament, dated about the 12th of December 1830, when I was last in Halifax and witnessed by FANNY ANN ARRINGTON, it is my will & desire that the same shall be considered null & void & of none effect. The same not being my will at this time.
Art. 2d. It is my will and desire that all my just debts may be speedily and punctually paid by my Executors.
Art. 3rd. I give and bequeath to my infant son JOSEPH JOHN WILLIAMS DRAKE the whole of my Estate both real & personal, provided nevertheless and let it be understood, that if my said son JOSEPH JOHN WILLIAMS DRAKE should die without lawful issue, then & in that case it is my will & desire that the whole of the aforesaid estate, both real & personal shall go to my own brothers & sisters each share & share alike. And provided also that all that part of my my Estate that may fall to my sister JOANNA W. ARRINGTON shall & is given in trust to my brother JOHN H. DRAKE for her use & benefit of my said sister JOANNA W. ARRINGTON & her children.
Art. 4th. It is my will & desire that my Negroes shall not be hired out & scattered about the country, but that both my plantations at Shaws and Oakland shall be kept up & carried on by my Executors pretty much in the same way as they are at present.
Art. 5th. And lastly, I do hereby constitute & appoint my brother in law JOSEPH JNO WILLIAMS and my own brother JOHN H. DRAKE JR. my Executors to carry this my last Will and Testament into full effect. In witness whereof I have here unto set my hand & seal this 21st December A.D. 1830.

In the name of God Amen
I ALBRRITTIAN JONES of the County of Halifax and State of North Carolina. Whereas it hath pleased the same to bless me with a portion of worldly good and in order to prevent any controversies that might arise touching the same do make and ordain this my last will & testament in manner & form following to wit
First my will and desire is that the whole of my Estate to remain as it now is until any of my children shall arrive at the age of Twenty one then to receive an equal share of the Negroes at valuations should the desire it. All the stock and crop that may be on hand to remain for the neutral benefit of my wife & children from year to year leaving it at the discretion of my wife what portion of stock to give to any of my children the same to be valued and an account to be kept so that each child to have an equal share upon the final settlement.
Secondly, I leave it discretionary with my wife & son WILLIAM H. JONES either to hire out a part of the Negroes or to continue them on the farm. The annual proceeds to be applied together the claims due me, to the payment of my debts and all expenses that may accrue from time to time. The amount of money necessary to educate my four youngest children shall be reserved out of the whole of my Estate say for one years schooling for each of the two youngest sons. Also my daughter MARTHA to have one years schooling My daughter SARAH JANE to receive an education equal to that of the rest of my daughters.
Thirdly, I wish for the whole of landed Estates to remain as it is, during my wife widowhood and at her death the same to be sold on such terms as may be thought best & the proceeds thereof to be equally divided among all my children.
In view of the division of property among my children That is IZABELLA F. R. JONES, PATIENCE REBECCA JONES, WILLIAM H. JONES, MARY E. JONES, JAMES A. JONES, JOHN W. JONES, MARTHA L. JONES & SARAH J. B. JONES. my wife is to retain a childs part during her life.
Lastly, I do hereby constitute and appoint my beloved wife, ELIZABETH JONES my Executrix and my son WILLIAM H. JONES my Executor of this my last Will and Testament Signed sealed and acknowledged this the 11th day of January 1845.

JONES part of said expense say $14 deducted from $50.88 and there is still due for said expense $36.88 which amount is to be paid by WILLIAM H. JONES to JOSEPH G. STALLINGS. Deduct $36.88 from $61.12 (over a share) and there is a balance of $24.24 due the Estate from said WILLIAM H. JONES.
