TO THE HONORABLE CLERK OF SUPERIOR COURT OF HARNETT COUNTY:
Your petitioners respectfully show unto the court:
I. That Boliver McRae, late of Harnett County, N.C. died intestate about 1948; that he left no
lineal descendants; that his wife, Mary Jane McRae is now deceased.
II. That the heirs of Boliver McRae, deceased, are the parties to this action, being lineal descendants
of the uncles and aunts of Bo1iver McRae, said uncles and aunts being David McRae, Christian McRae Black,
Neill McRae, Isabella McRae, Neill Archibald Stewart, David Stewart, Flora Ann Stewart & John Stewart,
Daniel McRae, Mary McRae; and that said descendants are the only heirs-at-1aw of Bo1iver McRae.
III. That at his death, Bo1iver McRae was the owner of a tract of land situate, in Upper Little River
Township, Harnett County, North Carolina, as follows:
All the land which Bo1iver McRae died seized and possessed of,
containing approximately 150 acres, more or less, which said land is
referred to in a deed dated April 3D, 1948, recorded in book 310,' page 574,
Harnett County Registry, and a deed dated March 12, 1973 recorded in
book 588, page 124, Harnett County Registry.
A metes and bounds description of the said land is not available at the
filing of this petition, and a survey of the said land is necessary for an accurate determination of
the boundaries of said land.
IV. That the heirs at law of the said David McRae are jointly the owners of a one-tenth undivided
interest in said lands; that the petitioners are advised and believe that the surviving heirs of
David McRae and the interest of each of said heirs in the lands of Boliver McRae is as follows:

guardian at litem should be appointed to represent said unknown heirs, if any, who would be jointly
the owners of a one-tenth undivided interest in said lands; that if it be determined that there are
no heirs at law of Neill McRae, then the aforesaid one-tenth interest should be divided among the
living heirs of Boliver McRae as their interest may be.
VII. That the heirs at law of the said Christian McRae Black are jointly the owners of a one-tenth
undivided interest in said lands; that plaintiff is advised and believes that the said heirs of
Christian McRae Black and the interest of each of said heirs in the lands of Boliver McRae is as follows:

XIV. That a guardian ad litem should be appointed to represent the unknown heirs of Daniel McRae,
the unknown heirs of Neill McRae, the unknown heirs of Raymond Hudson, the unknown heirs of Addie
Vuncannon, and any other unknown heirs.
XV. That the petitioners desire that the said lands be sold for division for that the interest of
each of the co-tenants is such that an actual partition of the said lands would not be advisable or
feasible and that a division cannot be made without injury to the joint tenants.
XVI. That a commissioner should be appointed to sell the said lands for division and that the net
proceeds from the said land, after the payment of the costs, including all legal fees and commissioners'
fees should be distributed to the said tenants in common as their interest appears in this petition.
WHEREFORE, these petitioners pray the court as follows:
1. That a guardian ad litem "be&#middot; appointed to represent the unknown heirs of Daniel McRae, the
unknown heirs of Neill McRae, the unknown heirs of Raymond Hudson, the unknown heirs of Joe Frank McRae
and the unknown heirs of Addie Vuncannon.
2. That a guardian ad litem be appointed to represent the interest of the unknown heirs and those
heirs not served by process.
3. That an order issue ordering a sale of the said lands for division and that a commissioner be
appointed to sell the said lands at public auction and the net proceeds be divided among the tenants
in common as their interest appears, after the payment of costs and expenses, including attorneys fees
and commissioners fees.
4. That the court order a survey of the said property described herein for an accurate determination
of the metes and bounds of the land in question, and that the Clerk of Court appoint a surveyor to make
said survey and report his findings to this court.
