Illegitimate Children

Illegitimate Children and Their Parents
Mentioned in Nash County Court Minutes
1787 to 1835

If you can’t find your ancestors, perhaps you should broaden your view and jump into the century you are researching. Try reading history books about the times, or better still, the COURT MINUTES! What an insight into how interwoven and tangled our ancestors were with their neighbors in lawsuits, building roads, fights, estate settlements, and bastardy bonds.

The abstractions below were taken from readings of the records by Dr. Stephen E. Bradley Jr. and Timothy W. Rackley in their series, “Nash County, North Carolina, Court Minutes Vol. 1 to Vol. 13. Please consult the original books and/or the original records for complete citations. They are well worth the money, never short yourself by asking people to do “lookups”, you need to read an entire year or so to understand what your ancestors are doing in most cases.

“Matters of bastardy normally include the mother’s sworn statement of paternity (generally mentioned but not transcribed) and an order for reputed father to support the child to some extent. The child’s name and gender are rarely given, although its age or time of birth may be. Bastards took the mother’s surname–a child referred to as John Smith of Mary was almost certainly illegitimate.” Fines were levied so public was not charged for private misconduct but court could alter, extend or rescind its orders. Bastard children were, in most instances, apprenticed to others to learn a trade. (from “North Carolina Research: Genealogy and Local History” by Helen F. M. Leary, Ed.). The apprenticed changed over the years as the child grew to legal age, thus the person you are interested in may be listed more than once.

Effort has been made to give all important information below. Many times, as in later minutes kept, just the man and women’s name were given with the fine but rarely child’s name or sex. Typical entry: “Ordered that Redmun Bunn pay to Sally Harris $15 for first year and $10 annually for next six years for support of her illegitimate child of which he is the reputed father.” This entry would most likely be abbreviated below as “Redmund Bunn and Sally Harris” since the rest of the legal details are standard.

Aug Court 1822
Ordered that the Shff pay to Temperance Hendrick thirty Dollars, the amount of TWO cases that issued from Nash County Court at the instance of the State vs Pilgrim L. Williams returned to this Court & c.

These “Hendrick” children usually took on the mother’s maiden name, but in this case I believe Temperance MIGHT HAVE BEEN already married, so perhaps they took on her married name with a Hendricks (see below). Notice will indicates son Granberry was deceased by 1848 and there is no William (which doesn’t mean anything). This record is presented for consideration, not as proof that the Temperance above is the same as the Temperance below

1 Apr 1848 – Temperance Hendrick, mother of Nancy, made her will.
2. Son, Henderson W. Hendrick – lands adjoining Wm. B. Bryant…29 1/2 acres.
3. Elizabeth M. Strickland, my granddaughter
4. Mary W. Strickland, my granddaughter.
5. Daughter Nancy Strickland [Nancy Hendricks married Edward Strickland, son of Noah
Strickland]
6. Son Granberry Hendricks, decd, 1/4 of money or land to his heirs – not named.
7. 1/4 of money to children of Wright B. Hendricks.
8. 1/4 to children of John Hendricks.
9. Children of Redding Hendrick.
Exec: J. J. Taylor. Wit: Robert D. Deans, Guilford H. Williams.
I am not a Hendricks researcher, but someone once told me Wright B. Hendricks, John and Redding were indeed Temperance’s children.
