Will of Judia Ireland

June 1, 1885


I Judia Ireland of the County of Pamlico and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form as follows

First - I give and devise to my six daughters all my personal estate to equally divided between Martha Ann Ipock, Mary Caroline Ireland, Sabrina Dixon, Parlia Ireland, Laura Allis Ireland and Judia Ireland.

Second - I give and devise unto my sons David D. Ireland and Israel M. Ireland all of my real estate consisting of fifty acres the same being now my homestead to be equally divided between my said two sons, but on the following conditions that my said sons D.D. Ireland and I.M. Ireland shall make an annual payment to my daughter Judia Ireland of the sum of Five Dollars each during her natural life.

Third - That I do hereby revoke and declare utterly void all other wills and testaments which may have been made by me heretofore.

In witness whereof I the said Judia Ireland do hereunto set my hand and seal this the 1st day of June AD 1885.

Signed sealed published and declared by the said Judia Ireland to be her last will and testament in the presence of us who at her request and in her presence do subscribe our names as witnesses thereto

     A paper purporting to be the last will and testament of Judia Ireland is exibited before me the undersigned, C.S.C, for said county by Israel M. Ireland and the due execution thereof by the said Judia Ireland by the oath and examination of Thomas A. Powers and myself the subscribing witnesses thereto who being duly sworn both depose and say and each for himself deposeth & saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Judia Ireland that the said Judia Ireland in the presence of this deponent subscribed her name at the end of said paper writing which is now shown as aforesaid and which bears date of June 1st AD 1885 and the deponent further saith that the said Judia Ireland the testator aforesaid did at the time of subscribing her name as aforesaid declare the said paper writing so subscribed by her and exibited to be her last will and testament and this deponent did there upon subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of said testator and this deponent further saith that at the said time when the said testator subscribed her name to the said last will as foresaid and at the time of the deponent subscribing his name as an atesting witness thereto as aforesaid the said Judia Ireland was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge information or belief of this deponent and further these deponent say not.

Note: Judia Lupton, born May 1824, parents unknown, was the widow of David Daniel Ireland, born abt 1814, parents unknown. Judia Ireland along with her husband & children are found in the 1850, 1860, 1870 & 1880 census.  Her will and probate year are listed as 1885, however, it does not say she is deceased.  In 1900 she is listed as age 76, widowed, mother of 10 w/ 6 living, hd of hhd #63-66 with some of her children and grandchildren.  It does seem to be the same person because of location, children and grandchildren so apparently Judia died after 1900.  If anyone has a death date for Judia please let me know.
