The Last Will and Testament of

JAMES B. PRITCHARD

March 23, 1883-May 9, 1883

 

In the name of God Amen.

I JAMES B. PRITCHARD being at this time of sound and disposing mind and memory do make publish and declare the following to be my Last Will and Testament, hereby revoking and annulling all others heretofore made by me.

First: I give to my Wife LOUISA for and during the period of her natural life, all my personal and real estate of whatever kind and description.

Second: I give and bequeath to my Daughter POLLY and my Son JAMES all my personal property household and kitchen furniture that maybe remaining after the death of my Wife LOUISA.

Third: I give and bequeath to my Son JAMES after the death of my Wife LOUISA , the tract of land whereon I now reside together with a tract of land which I purchased of Ephraim Harris and Timothy Black and is known as the “Clark Land”

Fourth: I give and bequeath to my Daughter POLLY after the death of my Wife LOUISA the tract of land known as the “Sexton Land” said to contain about Thirty Two acres.

Fifth: I give to my Grandson BERTRAM PRITCHARD after the death of my Wife LOUISA, the tract of land in Perquimans County lying on the Cove Road and known as the “Gilbert Land” and said to contain Forty Nine and One Half acres.

Sixth: I give and bequeath to my Grand children ANNA E. PERRY and LAURA PERRY the sum of Ten dollars each, to be paid in the following manner Ten Dollar to ANNA E. PERRY by my Daughter POLLY and Ten dollars to LAURA PERRY by my Son JAMES.

Seventh: I give to my Daughter HARRIET ANN MILLER the sum of Three Hundred Dollars to be paid in the following manner: One Hundred Dollars by my Daughter POLLY and Two Hundred Dollars to be paid by my Son JAMES.

Eighth: I hereby nominate and appoint my Son JAMES PRITCHARD to be executor of this my Last Will and Testament, This March 23, 1883.

  A paper purporting to be the Last Will and Testament of JAMES B. PRITCHARD deceased is exhibited before me the undersigned Judge of Probate for said County, by LOUISA PRITCHARD widow, of the said deceased and the due execution thereof proven on oath & examination of Arthur Pritchard and W.F. Pritchard, the subscribing witnesses thereof who being duly sworn doth depose and say and each for himself saith that he is a subscribing witness to the paper writing now shown him purporting to be the Last Will and Testament of JAMES B. PRITCHARD that the said JAMES B. PRITCHARD, in the presence of these deponents subscribed his name at the end of the same paper writing which is now shown as aforesaid, and which be on date of the 23rd day of March 1883. And the deponent further saith that at the time when said testator subscribed his name to the said Last Will as aforesaid and at the time of the deponents subscribing his name as an attesting witness thereto as aforesaid the said JAMES B. PRITCHARD was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge information or belief of this deponent.

And further then deponents say that the executor named in said Will and the 8th clause thereof is not of full age, being only about Sixteen years old.

Now therefore it is considered that the said paper writing is proven in due form of law, and it is adjudged that the same and every part thereof is the Last Will and Testament of JAMES B. PRITCHARD deceased, and it is ordered that the same be recorded

THOMAS PRITCHARD (1804 Will)

The Last Will and Testament of

THOMAS PRITCHARD

May 17, 1804-September 1804

State of North Carolina

Pasquotank County

In the name of God Amen I THOMAS PRITCHARD of the County aforesaid being sick and weak in body but of sound mind and disposing memory blessed be God do this Seventeenth day of May One Thousand Eight Hundred and Four make and publish this my Last Will and Testament in the manner following that is to say

Item: I give and bequeath unto my Son LEMUEL PRITCHARD one half of the lands that I bought of Jesse Jackson and Tamer Sexton to him and his heirs forever.

Item: I give and bequeath unto my Son ARTHUR PRITCHARD the other half of the lands that I bought of Jesse Jackson and Tamer Sexton to be eaqually divided between LEMUEL & ARTHUR PRITCHARD to him and his heirs forever.

Item: I give and bequeath unto my Son ISAAC PRITCHARD one half of the land and plantation whereon I now live that half that is next to Malachi Pritchard lands so as to take in my dwelling house to him and his heirs forever.

Item: I give and bequeath to my Son THOMAS PRITCHARD the remaining part of my lands that I have not givin away before to him L& his heirs forever.

Item: I leave the use of all that part of my plantation from Malachi Pritchards line to the mill swamp where on my building is on binding on a ditch that is back of my orchard between that and the ridge to my loving Wife LYDDA PRITCHARD during her widowhood or life like wise one feather bead and furniture one juniper table one cedar chest, one young mare named Pleasher, one cow her own horse, one ew and lamb one sow six shotes Ten barreles of Indian corn one plough and harness one loom one ax one iron pot One iron tea kittle Three flag bottom cheers one linen wheel one wollen wheel one pewter dish one pewter bason three pewter plates six earthen plates one washing tub one pail one bread tray one hackle during her widowhood or life And after her death or marrage to be eaqually divided eaqually among my Five Daughters viz: DORCAS SMITHSON, ELIZABETH CARTWRIGHT, MARY PRITCHARD, DOLLY PRITCHARD & SUSANAH PRITCHARD to them and their heirs forever.

Item: I give and bequeath to my Son THOMAS PRITCHARD my hand gun.

Item: I give and bequeath to my SAMUEL PRITCHARD six silver dollars to him and his heirs forever.

Lastly I leave all the remaining part of my estate that I have not given away before in legacies before to after paying my just debts, to be eaqully divided between my Five Daughters DORCAS SMITHSON ELIZABETH CARTWRIGHT MARY PRITCHARD DOLLEY PRITCHARD & SUSANAH PRITCHARD.

Item: my will and desire is that if either of my Sons LEMUEL or ARTHER PRITCHARD should die with out heir that the surviver should have all the lands that is willed them both

Item: my will and desire is that if either of my Sons THOMAS or ISAAC PRITCHARD should die with out heir then the surviver should have all the lands that is willed to them both and I hereby make and ordain my Son SAMUEL PRITCHARD & HEZEKIAH CARTWRIGHT Executors of this my Last Will and Testament

The Last Will and Testament of THOMAS PRITCHARD deceased was exhibited in open Court by SAMUEL PRITCHARD and Hezekiah Cartwright the Executors therein named and proved in open Court by the oath of David Pritchard one of the subscribing witnesses thereto, the said Executors qualified agreeable to law ordered that the will be recorded and letters Testamentary issue.

THOMAS PRITCHARD

June 22, 1755-July 1760

Be it know unto all men by these present that I THOMAS PRITCHARD of the place afsd. being sick & weak in body of sound & disposing mind & memory thanks be to God therefore calling to mind the motality of my body & knowing that it is appointed once for all men to die the time when uncertain L& now for the settling of my personal affairs I do make & ordain this my Last Will & Testament that is to say princepaly first of all I recommend my soul into the hands of God that gave it & my body to be decently buried at the discretion of my Executors heareafter named & as touching such worldly estate wherewith it hath pleased God to bless me with in this life I give and despose of the following manner & form that is to say I will that all those just debts & contracts as I do owe in right to any manner of person or persons be well & truly contented & paid or ordained to be paid in convenient time & place after my decease by my Executors hereafter named.

Item: I give to my Son THOMAS PRICHARD Three Negro boys one named Jacob, one named Dick and the other called Nedd; also I give to my afsd. Son THOMAS one young mare called Pleasure her and her increase also Two young cows & Two calves and Two sows and pigs and one black walnut ovil table also one good feather bed and furniture three leather chairs, half a dozen new pewter plates Two dishes and basons One two handle silver cup Two young stears about Three years old One middle sized iron pot also all my shoe makers tools also Two young Ews and Two lambs also one small cedar chest and One large white chest with a double dancet? Lock and one Twelves bottle case.

Item: I give to my Son JOSEPH P RICHARD Three Negro boys named Sam, Will and Boson also One young mare colt her and her increase also Two cows and to calves, young ones also Two sows & pigs & Two young ews and lams & Two Three year old stears also One writing desk also One small square Black Walnut table also One iron bound chest and One god fether bed and furniture and Three leather chairs & half a dozen new pewter plates to new pewter dises and Two new pewter basons & four silver spoons and One middle sized iron pot also One Twelve Bottle case red coular.

Item: I give to my Two Sons One brass kettle and the wind mill throes together with the iron works there unto belonging and one hand mill to be equally divided between them.

Item: I give and bequeath unto my dear and loving Wife ELIZ. PRICHARD one negro man named Moses one negro woman called Dinah and One negro woman called Moll to her and her heirs forever, also all the remainding part of my whole estate to my true and Loving ELIZABETH PRICHARD to her and her disposing forever, and furthermore my will is my Wife ELIZ. Have her third in my above mentioned land during the term of her widowhood but if she should happen to marry then my will is that my afsd. Wife ELIZ. Peaceably surrender all her rights of dowry and thirds of all the above mentioned land to my Sons afore mentioned.

Lastly: I do hereby nominate constitute and appoint my true and Loving Wife executrix of this my Last Will and Testament & likewise my loving son THOMAS PRICHARD and my loving Cosen JOSEPH PRICHARD and my trusty friend Thos. Nicholson Executors of this my Last Will and Test. Revoking disannulling and making void all former or other wills lagacies bequests & exers. By me before this time made named willed and bequeathed ratifying & confirming this and no other to be my Last Will & Testament.

In witness wereof I have hereunto set my hand & seal this Twenty Second day of the Sixth month commonly call’d June in the year One Thosand Seven Hundred & Fifty Five.

These may certify that Sam Swann Esq. Appeared in open court and made oath on the Holy Evengelist that he was present & saw THOMAS PRICHARD sign seal publish pronounce and declare the within to be and contain his Last Will and Test. & that he was at that time of sound & disposing memory & that he also saw John Ferrell & Thomas Grandy the other Two evidences sign their names there to at the same time. Then appeared THOMAS PRICHARD exec. Was duly qualified ordered that the Honerable Rich. Speight Esq. ??? have notice that letters issue.
