{"id":7841,"date":"2013-05-10T08:35:11","date_gmt":"2013-05-10T12:35:11","guid":{"rendered":"http:\/\/ncgenweb.us\/pasquotank\/?p=7841"},"modified":"2022-02-15T16:47:35","modified_gmt":"2022-02-15T21:47:35","slug":"peter-pritchard-1867-will","status":"publish","type":"post","link":"https:\/\/ncgenweb.us\/pasquotank\/peter-pritchard-1867-will\/","title":{"rendered":"PETER PRITCHARD (1867 Will)"},"content":{"rendered":"<p align=\"center\"><span style=\"font-size: medium\">The Last Will and Testament of<\/span><\/p>\n<p align=\"center\"><strong><span style=\"font-size: medium\">PETER PRITCHARD<\/span><\/strong><\/p>\n<p align=\"center\"><span style=\"font-size: medium\">March 26, 1867-June 1867\u00a0<\/span><\/p>\n<p><span style=\"font-size: medium\">In the name of God Man.<\/span><\/p>\n<p><span style=\"font-size: medium\">I <strong>PETER PRITCHARD<\/strong> of the County of Pasquotank and State of North Carolina being of sound and disposing mind do make publish &amp; declare the following as my Last Will and Testament to wit:<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 1<sup>st<\/sup>: It is my desire that my executor hereinafter named shall first pay all my just debts in manner as I hereinafter direct.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 2<sup>nd<\/sup>: I give and bequeath to my Sons <strong>PHILLIP PRITCHARD<\/strong> and <strong>RICHARD PRITCHARD<\/strong> Two Hundred Dollars each to be paid by my executor hereinafter named, out of the proceeds of the sale of my corn now on hand at the Weeks farm.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 3<sup>rd<\/sup>: I give to my beloved Wife <strong>OLLEY PRITCHARD <\/strong>during the term of her natural life all my land except the <b><i>PRITCHARD tract<\/i><\/b> formerly owned by <strong>PHILLIP PRITCHARD <\/strong>decd. And the <b><i>Jamima Thornton tract<\/i><\/b>. I also give to my Wife <strong>OLLEY <\/strong>during the term of her natural life all my household and kitchen furniture and all my cattle &amp; stock of whatever kind and all the balance of my corn not given away in Item No. 2, and all my crop of wheat now growing together with all the balance of my property of whatever kind and description.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 4<sup>th<\/sup>: I give and bequeath to my Sons <strong>JOSIAH PRITCHARD, ELIAS PRITCHARD, PETER PRITCHARD, STEPHEN PRITCHARD, PHILLIP PRITCHARD<\/strong> and<strong> RICHARD PRITCHARD<\/strong> to be equally divided among their share &amp; share alike. The said <b><i>PRITCHARD tract<\/i><\/b> formerly belonging to <strong>PHILLIP PRITCHARD <\/strong>decd, But it is my Will that all my just debts be charged against the said <b><i>PRITCHARD tract<\/i><\/b> and that my executor herein after named require my Son to whom the said tract is conveyed herein to rais an amount sufficient to pay the same and fully and entirely pay the same.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 5th: After the death of my Wife I give and bequeath to my Sons <strong>WM. RILEY PRITCHARD, JOSIAH PRITCHARD, ELIAS PRITCHARD, PETER PRITCHARD, STEPHEN PRITCHARD, PHILLIP PRITCHARD, <\/strong>and<strong> RICHARD PRITCHARD<\/strong>, all the balance of land together with all the balance of my property of whatever kind and description.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 6<sup>th<\/sup>: It is my desire that my Son <strong>WILLIAM RILEY PRITCHARD<\/strong> shall have his share of the land herein devised to him in the <b><i>Thornton tract<\/i><\/b> adjoining the Clark land to extend from Evan F. Pritchard land to the Whitehurst land.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 7<sup>th<\/sup>: If any of my Sons should die not leaving lawful issue it is my will that his share of my estate herein devised shall be equally divided among my surviving Sons.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item Eight: I give and bequeath to my Daughter <strong>SOPHIA DAILY <\/strong>Two Hundred Dollars to be paid to her within Five years from the time of my death by my Sons <strong>WM. RILEY PRITCHARD, JOSIAH PRITCHARD, ELIAS PRITCHARD, PETER PRITCHARD, STEPHEN PRITCHARD, PHILLIP PRITCHARD <\/strong>and<strong> RICHARD PRITCHARD<\/strong> or the survivors of them and it is my desire that the lands herein above devised to them be charged with the payment of the said sum of Two Hundred Dollars.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 9<sup>th<\/sup>: I give and bequeath to the Two children of my Daughter <strong>SARAH BRITE, SOPHA <\/strong>and<strong> ANNA <\/strong>a bed &amp; cow that I loaned to my said Daughter <strong>SARAH<\/strong> and which are now in the possession of the Father of the said <strong>SOPHA<\/strong> &amp; <strong>ANNA<\/strong>.<\/span><\/p>\n<p><span style=\"font-size: medium\">Item 10<sup>th<\/sup>: I nominate and appoint my Son <strong>ELIAS PRITCHARD <\/strong>executor of this my Last Will and Testament March 26, 1867.<\/span><\/p>\n<p><span style=\"font-size: medium\"><strong>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 PETER PRITCHARD <\/strong>seal<\/span><\/p>\n<p><span style=\"font-size: medium\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0His x mark<\/span><\/p>\n<p><span style=\"font-size: medium\">Signed in presence of<\/span><\/p>\n<p><strong><span style=\"font-size: medium\">Wm. Pritchard<\/span><\/strong><\/p>\n<hr \/>\n<p>North Carolina<\/p>\n<p><span style=\"font-size: medium\">Pasquotank County<\/span><\/p>\n<p><span style=\"font-size: medium\">Court of Pleas &amp; Quarter Sessions<\/span><\/p>\n<p><span style=\"font-size: medium\">June Term AD 1867<\/span><\/p>\n<p><span style=\"font-size: medium\">The forgoing paper writing purporting to be the Last Will and Testament of <strong>PETER PRITCHARD<\/strong> decd. Is exhibited for Probate in open Court by <strong>ELIAS PRITCHARD<\/strong> the executor therein named &amp; the due execution thereof by the said <strong>PETER PRITCHARD <\/strong>is proved by the oath &amp; examination of <strong>Wm. B. Pritchard<\/strong> &amp; <strong>James B. Pritchard<\/strong> the subscribing witnesses thereto. It is therefore considered by the Court that the said paper writing and every part thereof is the Last Will and Testament of the said <strong>PETER PRITCHARD<\/strong> and the same is ordered to be recorded &amp; filed, and thereupon the said <strong>ELIAS PRITCHARD<\/strong> executor as aforesaid duly qualifies as such by taking the oath required by law.<\/span><\/p>\n<p><span style=\"font-size: medium\">A.P.
