The Last Will & Testament of Byrn Smith - 1840

State of North Carolina Richmond County August the 14th 1841
In the name of God Amen. I BYRN SMITH of the above State & County being of
sound and perfect mind and memory, belefied be God, do this day make and
publish this my last Will and Testament in manner following viz; first I
give and bequeth unto my daughter ELIZABETH my mare ( ? ) bridle and saddle
and three cows and calves, and all my household and kitchen furniture, and
twelve killable hogs, one cart, one note of one hundred dollars on her
brother JAMES P SMITH due the 1st day of January 1840, also another note on
said JAMES P SMITH of one hundred dollars due the 1st day of January 1842
and twelve head of geese, and secondly I request that the other note I hold
against my son JAMES P SMITH of one hundred dolllars due the 1st day of
January 1843, be divided in the following manner viz; to my wife ELIZABETH
twelve dollars and fifty cents. To my son DANIEL SMITH fifty dollars to my
son ALEXANDER SMITH twelve Dollars & fifty cents, to my son JAMES P SMITH
twelve dollars & fifty cents, to my son WILLIAM SMITH twelve dollars &
fifty cents. I also direct that my daughter NANCY BROWN receive twelve
dollars of the note that I have given to my duaghter ELIZABETH, against my
son JAMES P SMITH due the 1st day of Janurary 1840, and I hereby make and
_______ my worthy friend THOMAS GIBSON & my son DANIEL SMITH Executors of
this my last Will & Testament set my hand & seal the day and year above
written. BYRN SMITH
Signed sealed published and declared by the said Byrn Smith, the Testator,
as his last Will & Testament, in presence of us who were present at the
time of signing & sealing thereof
