This indenture made this third day of January in the
yar of our Lord one thousand seven hundred and
ninety five between James Huddleston of the
County of Rutherford and state of North Carolina of
the one part and James and Hezekiah Huddleston
of the County and State aforesaid sons of the said
James Huddleston of the other part witnesseth that
the said James Huddleston for and in the
consideration of the natural …
Said James and Hezekiah Huddleston and for the
better maintainance of them the said James and
Hezekiah Huddleston hath alienated enfeafed and
confirmed and by these presents doth give grant
alien enfeof convey and confirm unto the said James
and Hezekiah Huddleston that massage or tenement of
land situate lying and being in the County of
Buncomb and state aforesaid on a branch of the main
fork of Mud Creek on the north side including
the timber ridge, beginning at a post oak,
thence north sixty six west one hundred and eighty
poles to a white oak and so on by survey two hundred
acres of land which was granted to Joseph Flinn
bearing date the first of January 1794 with all and
singular its appurtainances and all houses outhouses
lands &c the reversions and reversions remainder &
remainders rents and services of the said premises
and also all the estate right title interest maherty
claims and demand whatsoever of him the said James
Huddleston of in and to the said message or tenament
land and premises and of in and to every part and
parcel thereof with the appurtainances and all deeds
evidences and writing concerning the said premises
only now in the hands or custody of the said James
Huddleston or which he may get or come by without
debt in law to have and to hold the said message or
tenement of land hereditaments and premises hereby
given and granted or mentioned or intended to be
given and granted unto the said James and Hezekiah
Huddleston their heirs and assigns to the only
proper use and behoof of the said James and Hezekiah
Huddleston their heirs and assigns forever and the
said James Huddleston for himself his heirs
executors and administrator doth covenant promise
and grant to and with the said James and Hezekiah
Huddleston their heirs and assigns by these presents
that they the said James and Hezekiah Huddleston
their heirs and assigns shall and may lawfully from
thenceforth forever hereafter peaceably and quietly
have hold occupy?? And enjoy the said message or
tenement of land hereditaments and premises hereby
given and granted or mentioned or intended so to be
with their and every of their appurtainances free
and clear and discharged that will and jointly saved
and kept harmless of and from all former and other
gifts grants bargains and seals infrafments ?aintions
services and estates entails rents rent charge
avenges of rents statutes judgements recognizance
statute merchant and of the stable extents and of
and from all other titles troubles charges and
incumberance whatsoever had made committed done or
suffered to be had made done committed or suffered
by him the said James Huddleston his heirs executors
or administrators or any other person or persons
whatsoever lawfully claiming or to claim by for or
under him them or any thereof them. In witness
whereof the said James Huddleston hath hereunto set
his hand and seal this third day of January and year
first above written.
