This Indenture made this 2nd Day of October in the
year of our lord one thousand Eight hundred and one
Between Andrew McMurry of the County of Rutherford
of the one part and Benjamin Parks of the County of
Burke both of the State of North Carolina.
Witnesseth that the said Andrew McMurry for and in
consideration of the sum of thirty five Dollars in
hand paid by the said Benjamin Parks at and before
the sealing and Delivering of these presents to the
receipt and payment whereof is hereby acknowledged
the said Andrew McMurry for himself and his heirs
Doth bargain sell and confirm into the said Benjamin
Parks his heirs Exetr administrators forever a
certain piece or parcel of land in the County of
Rutherford it being a tract granted by patent to
Basel Sweesor on the East side of Hannah
Huddlestones land Beginning at a Red oak in said
Hannah Huddlestones line near the old Waggon Road
thence South sixty East forty poles to a chesnut and
post oak, thence North seventy East forty poles to a
black oak, thence North ten East eighty poles to a
pine, thence North forty West fifty six poles to a
stake, thence fifty two West one hundred and fifteen
poles to a stake, thence North fifteen East one
hundred and sixty poles to Hannah Huddlestones black
oak corner thence with the said line to the
beginning, containing one hundred acres be the same
more or less except the interface of Hannah
Huddlestones land with all ways woods waters and
every other appertanance thereto belonging or
appertaining to have and to hold to the said
Benjamin Parks his heirs Executors administrators &
Doth hereby Covenant and promise to and with the
said Benjamin Parkes his heirs Executors
administrators and assigns that the said Andrrew
McMurry his heirs Executors or administrators shall
and will warrant and defend the said piece of parcel
of land forever with all and every of its members
and apperainances free from all lawful claims of any
other person or persons whatsoever unto the said
Benjamin Parkes his heirs or assignees for ever in
witness whereof the said Andrew McMurry hath
hereunto set his hand and affixed his seal the Day
and year first above written signed sealed and
delivered in the precence of us
