No. 248 Know all men by these presents, that I
Elijah Fouch of Rutherford county in North Carolina
witnesseth that for & in consideration of the sum of
114 dollars to me in hand paid by James McMurry of
the same place the receipt & payment is hereby
acknowledged. I the sd Elijah Fouch have given
granted bargained sold conveyed & confirmed unto the
sd James McMurry & to his heirs & assigns forever a
certain piece or parcel of land in the county aforsd
on a branch of first broad river Beginning at a
hicory on the branch then S 15 W 58 poles to a
stake, thence S 82 E 81 poles to a post oak, thence
N 8 E 15 poles to a branch, then North 80 E 26 poles
to a Dogwood then S 50 E 48 poles to a post oak then
S 20 W 38 poles to a Spanish oak then North 85 E 52
poles to a pine then North 5 E 32 poles to a hicory
then North 10 W 38 poles to a maple in the head of
the branch then with the branch to the beginning
containing fifty two acres more or less with all the
buildings orchards & improvements hereidetaments or
appurtenances to the same belonging or in anywise
appertaining. To have & to hold all the above
granted parcels & premises to him the sd James
McMurry & to his heirs & assigns & that he & they
shall & may at all times hereafter have & to hold
all the above Granted Land & premises clear from all
incumberances in the law & that I the sd Elijah
Fouch will & shall warrant secure & ever defend all
the above land & premised free & clear from all the
lawful claims or demands of all persons & manner of
person whatsoever. In witness whereof I have
hereunto set my hand & the 28th day of November 1809
