May the 27th 1804 No. 44
This Indenture made this twentieth day January one
thousand Eight hundred and four, Between John Foch
of the County of Rutherford and State No. Carolina
of the one part and James McMary of the other part
of the Count and State aforesaid witnesseth that the
John Foch for the Inconsideration of the Sum of Ten
pounds North Currency to him in hand paid before the
sealing and Delivering of these presents the receipt
and payment whereof he the said John Foch Doth
hereby acknowledge that he hath Bargained Sold and
Delivered and Confirmed and do by these presents
Bargain Sell and Deliver unto James McMary his heirs
and assigns forever one certain trach or parcel of
land being and being in the County aforesaid on the
East Side of First Little Broad River, Beginning at
a post oak Wm McMorey line thence his line to ack’d
corner post oak in his line, thence nearly east to a
post oak thence north to Jo Sephgugorys Branch,
thence up said Branch to the old path thence along
said hath to a post oak corner thence to the said to
the said putmans line that he now lives on to the
East corner from thence to the Beginning, containing
25 acres more or less with all the improvements
hereditaments and thereunto Belonging to have and to
hold from any person or persons whatever all the
above granted land and premises to him the said
James McMorry and his heirs and assigns free and
clear from all incumbrances in the law and of the
John Fouch will and forever Defend all the above
granted land and premises from all the lawful claims
or demands of all persons or persons. In Witness
whereof I have hereunto Set my hand and Seal this
day and year above Written Signed Sealed Delivered
in presents of us
