I Edmen Alexander of this place, should it please God to take me hence or should I die and be no more here, for which I have every hope of being in a better world, than this, It is my desire and will if any of my servants or negroes should act in a disobedient and disordely manner for the manager of my estate to sell them.- Let it be male or female to the first speculator or for the greatest price they can obtain and secure the money for the benefit of my wife and children. An as to a will I declare I have none instrument but this knowing the same is a better one than I can make - Day and date above written - my hand and seal -

January Sesion 1831

The relinquishment by Roha Alexander wife of Edmon Alexander to the administration on her husbands estate was exhibited in open court and filed. On motion ordered that Joseph Alexander be appointed administrator on the estate of the said Edmon Alexander who entere into bond with the sum of five thousand dollars with George H. Alexander & Charles T. Spruill security.

A memorandum of direction left by Edmon Alexander deceased was exhibited in open court & the handwriting of Edmon Alexander proved by the oath of Zebulon Tarkenton, Mathew Brickhouse & Joseph Halsy let it be recorded Henry Alexander said it was found amongst his ? paper in his desk.

Ordered that Jos. Alexander administrator of Edmon Alexander have leave to sell the perishable estate of said deceased.

April Session 1831

Ordered that Jos. Alexander administrator of Edmon Alexander return on oath the account of sales of said deceased.

January Session 1832

Jos. Alexander administrator of Ed Alexander returns on oath an account of negro hire for the year 1831.

April Session 1832

Ordered that Hez. G. Spruill, George H. Alexander & Jos. Midget settle the account between Edmen Alexander former guardian to Abner Alexander & Jos. Alexander administrator of Edmen Alexander.

July Session 1832

Jos. Alexander returned into open court the audited account of the estate of Edmon Alexander former guardian to Abner Alexander and Abner Alexander due from the estate of Edmon Alexander to Abner Alexander $469.26.

January Session 1833

Ordered that Hez. G. Spruill, Jos. Midyett & Ephraim Mann audite & settle the estate of Edmen Alexander with the administrator.

Ordered that Jos. Alexander be appointed guardian to the heirs of Edmen Alexander.

April Session 1833

Jos. Alexander returned into open court the audited account of the estate of Edmen Alexander deceased due estate $503.89, also the division of the negros of Edmen Alexander amongst the heirs - also the hiring of the negros of the orphans of Edmen Alexander for the year 1833, also the division of the land of Caroline & Cary Ann Spruill.

April Session 1834

Account of the hire of the negros of orphans of Edmon Alexander for 1834 was returned into court.

October Session 1842

Ordered that Jos. Alexander renew his guardian bond as to Samuel Alexander and that he enter into a bond of eight thousand dollars with Abner Alexander, John McClees & Charles McClees securities.

Bond dated 24 Jan 1831 in the amount of five thousand dollars appointing Joseph Alexander administrator of the estate of Edmond Alexander deceased, George H. Alexander & Charles T. Spruill securities.

Petition January Term 1831 by Rhoda Alexander widow of Edmund Alexander for her years allowance from the estate of her deceased husband who departed this life on 6 Dec 1831 without leaving a last will & testament.

Laying off on 7 Feb 1831 of one years provisions to Rhoda Alexander widow of Edmond Alexander deceased by Mathew Brickhouse, Lemuel Basnight, James Forbes & James McAlester.

Petition January Term 1833 by Abner Alexander and wife Rhoda who say that Edmond Alexander died intestate in 1830 possessed of divers negroes which, along with other estate, came into possession of Joseph Alexander administrator of the said Edmd. and hitherto have not been divided between his children and your petitioner Rhoda who was then his widow and in that right ought to have a third, a child's part, set apart to her. Petitioners request notice be served upon the distributees of said Edmond to give cause, if any, why the negros should not be divided, and that three freeholders be appointed to effect such a division.

Petition January Term 1833 by Abner Alexander & Rhoda Alexander his wife stating that her husband Edmd. Alexander died intestate seized and possessed of a tract of land bounded by the lands of John Thoroughgood & Will Mann in which she is entitled to dower which she has yet to receive from the heirs at law of the said Edmund. Samuel & Mary Ann Alexander, minors, are the heirs at law of the said Edmund and Joseph Alexander is administrator of his estate. Petitioners pray that the Sheriff be ordered to summon a jury of freeholders to allot to her 1/3 of said land including the late dwelling house and outhouses of her late husband.

Laying off of the dower of Rhoda Alexander in the lands of her deceased husband Edmond Alexander on 27 Feb 1833 by Charles McClees surveyor, and Ephraim Mann, William Mann, Lemuel Basnight, Hardy Alexander, Warren Alexander, Reddick Alexander, Abraham Pledger, Joseph McClees, James J. Pledger, Frederick Davenport & James Swain and H. G. Spruill sheriff. She received 58 acres including all the improvements thereon.

Bond dated 30 Jan 1833 in the amount of ten thousand dollars appointing Joseph Alexander guardian of Mary Ann & Samuel Alexander minor orphans, Benj. Sikes, George H. Alexander & Enoch Hassell securities.

Bond dated 26 Apr 1836 in the amount of five thousand dollars appointing Joseph Alexander guardian of Mary Ann & Samuel Alexander orphans of Edmond Alexander deceased, Hezekiah G. Spruill & Jos. Halsey securities.

Bond dated 22 Apr 1839 in the amount of five thousand dollars appointing Joseph Alexander guardian of Samuel Alexander orphan of Edmund Alexander deceased, Thomas H. Alexander, Abner Alexander & Jno. McClees securities.

Promissory note dated 1 Jan 1839 to pay Joseph Alexander guardian of Samuel Alexander 81 dollars. Signed by Ash Cahoon & F. J. Cahoon and witnessed by Morgan F. Thomas.

Petition October Term 1838 by John McLees & Samuel Alexander by his guardian Joseph Alexander who are tenants in common and entitled to the following negroes viz. {blank} each being entitled to one half which they are desirous of being divided. Pray three freeholders be appointed.

Warrant dated 20 Oct 1840 for Ashberry Cahoon & Franklin J. Cahoon to appear before a Justice of the Peace on the 24th instance to answer the complaint of Joseph Alexander guardian of Saml. Alexander in a plea of debt in the amount of $81 and interest. Also summon Morgan J. Thomas for the plaintiff.

Bond dated 26 Oct 1842 in the amount of eight thousand dollars appointing Joseph Alexander guardian of Samuel Alexander orphan of Edmd. Alexander deceased, Abner Alexander, Charles McClees & John M. McClees securities.

Petition in the Court of Equity in Spring Term 1848 by Joseph Alexander guardian of Samuel Alexander who shows that his ward is entitled to three tracts of land in Tyrrell County, one tract of 15 acres upon which Selby Patrick resides, about 50 acres on Cow Ridge and one of about 25 acres at the head of Little Alligator. Said lands produce little or no revenue and, if sold, the interest on the money would exceed current income. Petitioner requests an order to sell the property. Sale was approved in the same term.

Petition January Term 1851 by Samuel Alexander saying that for many years Joseph Alexander has been his guardian, but Joseph Alexander is lately deceased and he, Samuel Alexander is now of age. To date he has only received partial distribution of his share of his father's estate, which is now under the control of Hezekiah G. Spruill administrator of the estate of Joseph Alexander. Said Spruill will not distribute the remaining estate to him without an accounting of the estate of Edmond Alexander's estate in the hands of Joseph Alexander. Petitioner prays such accounting be ordered by the court.

Audited account of Joseph Alexander guardian with his ward, Samuel M. Alexander, starting on 12 Feb 1833 to 1 Jan 1851. Balance due Samuel M. Alexander is $1588.35.


Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Edmund Alexander to Rhoda Midyett on 8 Feb 1819, Robert B. Webster security; also Abner Alexander to Rhoda Alexander on 4 May 1832, Thomas H. Alexander security.

The 1838 petition by John McLees and Samuel Alexander for division of the negroes indicates that John McLees was the husband of Mary Ann Alexander.
