Undated memo listing the heirs of Thomas Barnes. Ann Alexander is listed as a sister in Tyrrell who died before Thomas leaving 8 children.
Petition June Term 1797 by John Alexander against Stephen & James Barnes administrators of the estate of Thomas Barnes deceased. On 1 Aug 1786 Thomas Barnes & William Flood sold 178 acres on Midyetts Island in Tyrrell County to John Alexander. The deed describes it as being on the east side of the Great Swamp joining John Bateman's new survey and it was witnessed by Jos. Alexander & John Hoskins. In fact, 37 1/2 acres of this tract was owned by either Cornelius Morris or John Brickhouse. A suit ensued that lasted until September Term of 1798, with numerous depositions and court appearances by Thomas Warrington, Abner Alexander, Joseph Alexander Senr. son of Joseph and Jesse Alexander, all of Tyrrell County and all testifying for the plaintiff, John Alexander. In addition there was a notice dated 6 Sep 1797 to the defendants of a deposition being taken on 5 October next from Henry Alexander near Cumberland River in the state of Tennessee. There was also a summons on 6 Sep 1797 for Samuel Spruill, surveyor, to testify for the plaintiff. The deposition by Joseph Alexander Senr. in July 1797 at the house of Abner Alexander Esqr. states that in conversation Thomas Barnes once told him that there was a deficiency in the land he had sold John Alexander and that he intended to rectify the situation. John Alexander prevailed in the suit and an estate account of Thomas Barnes shows that L 382.10.1 was paid or due John Alexander. There is a receipt dated 5 Sep 1798 signed by Jno. Alexander for L 72.10 acknowledging partial payment by the administrators of Thomas Barnes of a judgement obtained in the county court of Pasquotank at this term. A notation on the back of an execution against the estate of Thomas Barnes filed in December 1801 in this suit reflects apartial payment to Sally Jackson of L 43.
Summons 6 Mar 1798 for John Alexander to appear at court in Pasqoutank County in June 1798 to answer the plea of the administrators of Thomas Barnes of a debt of L 100.
Summons 9 Jul 1798 for John Alexander to appear at court in Pasqoutank County in September 1798 to answer the plea of the administrators of Thomas Barnes of a debt of L 100. Sheriff's return says not to be found.
Division of the negroes of Thomas Barnes deceased on 14 Jan 1799. The heirs of John Alexander & Nancy his wife get Jenny & Caesor.
Bond of William Alexander with Samuel Spruill as security dated 5 Apr 1800 in the sum of L 256.12 to be paid to Stephen & James Barnes administrators of Thomas Barnes deceased. The condition of the bond is that William Alexander hold harmless and indmnify Stephen & James Barnes concerning the property that fell to a part of the heirs of Thomas Barnes deceased, that part of said deceased's estate that falls to by names as follows, Sally Alexander, Joshua Alexander, Patty Alexander, Mary Clark Alexander, Gibeon Alexander, Thomas Alexander, which the said William Alexander was appointed guardian for by the county court of Tyrrell, in and concerning their respective parts that fall to them by law, of the estate of Thomas Barnes deceased, we bind ourselves in the sum of L 128.2.7, to and with the said Stephen & James Barnes. Furthermore, if the said William Alexander well and truly satisfy the aforementioned heirs when he is called upon by them, the above obligation shall be void and of no effect.
Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of John Alexander to Ann Barnes on 11 Aug 1768, Joseph Spruill security.
From the above it can be determined that this John Alexander is the John Alexander in the Pasquotank records by virtue of the slaves inherited from
Thomas Barnes and subsequently sold by William Alexander and by virtue of matching names of the children.
Since Thomas Barnes died in late 1796, Ann Alexander was deceased before that. John Alexander apparently died in late 1798 since he signed a
receipt in September 1798 and the division of the negroes of Thomas Barnes on 14 Jan 1799 lists the heirs of John & Nancy Alexander.
