January Session 1842

Morris Weskett appeared in open court and resigned the guardianship of Thomas Alexander son of Hardy Alexander which resignation was accepted.

Ordered that the clerk of this court issue notice to the administrator of Hardy Alexander to lay his accounts before him and that the clerk audite and settle the same and report to the next term of the court.

Alexander, Hardy, 1839


Assignment on 24 Jul 1838 of the services of his share of negro boy George to Abram Alexander until George reaches the age of twenty-one years.

Petition January Term 1839 by Minerva Alexander, widow of Hardy Alexander deceased, showing that the said Hardy Alexander departed this life about the 19th day of the present month intestate seized and possessed in fee simple of a tract of land of about 50 acres joining the lands of Benjamin Spruill and others and that said Hardy left an only child a son Thomas Alexander his heir at law and petitioner is desirous of obtaining her dower in said land. She prays an order be issued to allot dower, an administrator be appointed for the estate and a guardian ad litem be appointed for Thomas Alexander.

Bond dated 23 Apr 1839 in the amount of fifteen hundred dollars appointing Abram Alexander administrator of the estate of Hardy Alexander deceased, Joseph Melson & Richd. A. Meekins securities.

Laying off of the dower of Manerva Alexander in the lands of her deceased husband, Hardy Alexander, on 29 Jun 1839 by John McClees, Sheriff, and Wm. Mann, John Sanderson, Joseph McClees, Joseph A. Spruill, Abraham Pledger, James Pledger, Reddick Alexander, Joseph Melson, Enoch Ludford, Thomas B. Midyett, F. Davenport & Joseph Caroon, freeholders unconnected to the widow. The tract of land was 49 acres lying in Little Alligator and the widow was alloted 16 acres beginning at the dividing line of Cyrus Hopkins and running northerly to the line of Alexander Hopkins thence along the dividing line of Colly Ann Pledger and Alexander Hopkins to the back line thence to the main road thence along the road to the fork and the dividing line of Cyrus Hopkins to the first station, containing the out houses and improvements thereto. This tract of land fell to Colly Ann Pledger in the division of the lands of Thomas Hopkins heirs.

Bond dated 27 Jul 1840 in the amount of fifteen hundred dollars appointing Morris Weskett guardian of Thos. C. Alexander orphan, Jos. Alexander & Jeremiah Weskett securities.

Petition October Term 1840 by Morris Weskett who has notice of a claim against Thomas Alexander's (infant of Hardy Alexander) estate for about fifty-six dollars, that he has no personal property and no real estate except a tract of land in remainder adjoining Jno. Combs heirs and Frederick Hayman's line containing 125 acres. He therefore prays that in as much as said land is liable to said debt and that the personal estate is exhausted, that said land be sold or as much as needed to satisfy said debt.

Summons by Charles McClees dated 26 Jul 1841 for Abraham Alexander administrator of Hardy Alexander deceased to come before a Justice of the Peace to answer the complaint of Benjamin Sikes in a plea of debt due by account in the amount of sixty dollars. This is preceded by several pages of the account.

The file contains many promissory notes from Hardy Alexander and accounts showing debts to Nathan A. Brickhouse, Benjamin Sikes, H. G. Spruill, Abraham Alexander & Elijah P. Melson. Also many summons and judgments relating to these creditors attempting to recover their money. Since there were no goods and chattels they went after the land that had descended to Hardy's son, Thomas Alexander. Abram Alexander was appointed administrator due to being the greatest creditor of Hardy Alexander.


Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Hardy Alexander to Minerva Bassnight on 19 Nov 1832, Ozias Roughton security. Minerva apparently remarried soon after Hardy's death since there is another bond for the marriage of Minerva Alexander to James B. Steely on 12 Oct 1840, B. B. Russell security.

James Steely (35), Minervy Steely (32) and Thomas B. Alexander (17) appear in the 1850 census living in Windsor, Bertie County, NC.
