April Session 1832

Ordered that Charles McClees be permitted to administer on the estate of Spencer Armstrong with {entry ends}.

July Session 1832

Charles McClees administrator of Spencer Armstrong returned into open court on oath the account of sales of the said estate amount $413.59.

The years allowance of Rebecca Armstrong was returned into open court & filed.

July Session 1833

Ordered that Holiway Armstrong be appointed guardian to Russel Armstrong orphan of Spencer Armstrong and give security in the sum of $500.

January Session 1834

Charles McClees guardian {administrator} of Isaac Belang returned in open court account of sales of said estate & account sale of Spence Armstrong ? & the ? years allow.

Ordered that Samuel C. Patrick, Thompson Liverman & Wm. Alfred audite & settle the estate of Spencer Armstrong.

Bond dated 24 April 1832 in the amount of two thousand dollars appointing Charles McCleese administrator of the estate of Spencer Armstrong deceased, George H. Alexander & Saml. Rogers securities.

Petition April Term 1832 by Rebecca Armstrong widow of Spencer Armstrong for the laying off of her year's provision.

Petition April Term 1832 by Rebecca Armstrong stating that her husband Spencer Armstrong has died intestate seized and possessed of a tract of about 200 acres bounded by the lands of Bartlett Jones, Zebedeee Smith and others. His heirs at law are John Armstrong, Ansalem Armstrong, Rosina Armstrong & Ester Armstrong, who are in possession but petitioner has not received her dower in said lands. Petitioner prays a jury of freeholders be assigned to lay off her dower including the dwelling house.

Summons dated the fourth Monday in April 1832 for John Armstrong, Ansalam Armstrong, Rosina Armstrong & Esther Armstrong heirs at law of Spencer Armstrong to appear at court on the fourth Monday in July next to show cause, if any, why the petition of Rebecca Armstrong widow of Spencer Armstrong for dower in her deceased husband's land should not be granted.

In obedience to a court order in April 1832, a years allowance is layed out of the estate of Spencer Armstrong for the widow Armstrong by Dempsey Liverman, Joseph White & Samuel C. Patrick. She received 72 dollars, one bed & furniture, one wheel and two cards.

Court order to the Sheriff dated 4 July 1832 to summon a jury to lay off to Rebecca Armstrong her dower in the lands of her deceased husband, Spencer Armstrong.

Laying off of the dower of Rebecca Armstrong in the lands of her deceased husband, Spencer Armstrong, on 2 October 1832 by the deputy sheriff, Charles McClees and twelve disinterested freeholders, Elikem Swain, Thomas Sawyer, Thomson Liverman, John D. Liverman, James Davenport, Joab Sawyer, Isiah Smith, John Richardson Jr., Ashbee Liverman, William Cahoon, Joshua White & Peleg Sawyer. The widow received 140 acres including the dwelling house and all outbuildings.

Bond dated 23 July 1833 in the amount of five hundred dollars appointing Holiway Armstrong guardian of Russell Armstrong orphan of Spencer Armstrong deceased, William Walker & Silas Davenport securities.

Bond dated 1 Dec 1837 for John Armstrong to appear at court on the fourth Monday in January 1838 to answer the claim of debt in the amount of $42.75 by Charles McClees administrator of S. Armstrong.

Summons dated the fourth Monday in January 1839 for Jno. Armstrong to appear at court on the fourth Monday of April next, to satisfy a judgement of $47.05 obtained against him by Charles McClees administrator of S. Armstrong. Not found by the sheriff.


Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Spencer Armstrong to Rebecca Brickhouse on 14 Sep 1828, Matthew Brickhouse security; also Anslum Armstrong to Nancy Johnston on 10 May 1832, William Wynn security; and also John Armstrong to Rachel Smith on 27 Apr 1829, Zecharias Neele security.

It would appear that Rebecca Armstrong was at least a second wife of Spencer Armstrong based on their marriage date and the age of the heirs. Since Russell Armstrong is a son of Spencer Armstrong in the above guardian bond in 1833 and is not listed as an heir in the petitions, it appears he may not have been born until after probate was initiated. The 1830 census supports this conjecture with only two male children listed for Spencer Armstrong, who is between 50 and 60 years of age.

The estate papers of Zebulon Tarkenton in 1834 list the heirs of Spencer Armstrong as Thomas White & wife Ester, John Armstrong, Ansolum Armstrong, Rosanna Armstrong & Russell Armstrong.
