In the name of God Amen I John Brickhouse of the state of North Carolina and County Tyrrell - being of perfect mind and memory do make and ordain this my last will and testament in the manner and form following viz. - -

Item. I leave the use of my dwelling house and plantation to my beloved wife Ann Brickhouse during her natral life or widowhood - -

I give and bequeath to my beloved wife Ann Brickhouse one mare named Pegg ? ? fether bed and furniture one cow and calf and one linnen wheal - -

Item. I give to my sons William Brickhouse and Enoch Brickhouse my land and plantation after the death or marriage of my wife to be divided between them Beginning at a pine on the north side of my plantation near the swamp running southardly to a gum in the plantation thence a direct course to the mane road then a long the road to the Run Bridge Enoch Brickhouse to have the eastern part and William Brickhouse to have the part the house stands on - -

Item. I give to my son John Brickhouse all my carpenters tools and to be bound to a trade and one hundred dollars to be paid him by my sons William Brickhouse and Enoch Brickhouse, William to pay two thirds and Enoch to pay one third - -

Item. I give to my daughter Catherine Brickhouse one feather bed and furniture one cow and calf and one ewe and lamb at her marriage or her coming to twenty one years of age

Item. I give to my son Jesse Brickhouse the plantation where on Jeremiah Stutman lives formerly the property of Isaac Davenport son of Stephen with one cow and calf - -

Item. I give to my son James Brickhouse the land formerly the property of Isaac Davenport son of Stephen ajoining the lands of Thomas Weatherley with one cow and calf - -

Item. I give my daughter Millia Brickhouse one feather bed and furniture one chest that was her mothers one cow and calf and one ewe and lamb to be delivered to her when married or leaving the family - -

Item. I give to my son William Brickhouse one young horse named Hazzard and one cow and calf his choice of the stock when he arrives at the age of twenty one years old and one ewe and lamb - -

Item. I give to my son Enoch Brickhouse one young horse named Black one broad ax one cow and calf we he arrives to twenty one years old - -

Item. I give to my daughter Elizabeth Brickhouse one bed and furniture one cow and calf and one ewe and lamb to be delivered when she gets married or arrives at twenty one years of age - -

Item. I give my daughter Clarresy Brickhouse one bed and furniture one cow and calf and one ewe and lam to be delivered when she gets married or arrives at twenty one years old - -

Item. I leave the use of all the rest of my estate that is not given away to my executors to raise my young children after my debts is paid and after my children is rased to be equally divided amongst all my heirs - -

I do hear by costitute and appoint my beloved wife Ann Brickhouse and my son William Brickhouse executors of this my last will and testament do utterly revoke disanull and disalow all and every other will or testament this and no other to be my last will and testament In witness I have hereunto set my hand and seal this the twenty third day of march one thousand eight hundred and nine 1809 - -

Court of Pleas & Q Sessions Oct T 1837 Then was this paper writing offered for probate by James Brickhouse a devisee therein, when the jury found it was not the last wil and testament of John Brickhouse whereupon the court refused admit the same to probate Court of 1 & 2 Septm October Term 1857
