In the name of God Amen.

I, William Brickhouse of the state of North Carolina and County of Tyrrell, being weak in body but of sound and perfect mind and memory Considering the uncertainty of this mortal life, and being of sound sense, blessed be almighty god for the same, do make and publish This as my last will and testament in a manner and form following that is to say first I give and bequeath to my beloved Daughter Aphia Brickhouse one negro girl named Peninah also one bed and furniture all the residue of my estate real and personal goods and chattles of what kind and nature soever I lend to my beloved wife Frances Brickhouse during her natural life after her decease I give & bequeath to my Daughter Orpah Brickhouse one negro girl named Mary I also give her one bed and furniture I do also give and bequeath to my Daughter Priscilla Brickhouse one negro girl named Flora also one bed and furniture. I do also give and bequeath to my son John Brickhouse all my land to him his heirs & assigns forever The residue of the said estate I leave to be equally divided between my four sons Allen Brickhouse Gilbert Brickhouse Nathan Brickhouse and Joseph Brickhouse that is to say the negroes ? ? & horses cattle and hogs household and kitchen furniture and all the tools I here by appoint my son Gilbert Brickhouse my sole executor of this my last will and testament and here by revoking all former wills by me made.

Codicil. If any of them should die without a lawful heir the property to return into the family again.

In witness whereof I hereunto set my hand and seal this the eighth day of February one thousand eight hundred and twenty five

April Session 1825

Gilbert Brickhouse came into open court & qualified as executor to the last will and testament of William Brickhouse deceased which said will was proved in open court by the oaths of Matthew Brickhouse Junr. & Uzzial Brickhouse subscribing witnesses to the same who also swore that they saw Peter Brickhouse Senr. sign the same as a subscribing witness thereto.

April Session 1834

The division of the negroes of Wm. Brickhouse returned into court & filed.

Petition January Term 1834 by Nathan Brickhouse, Joseph Brickhouse & Allen Brickhouse who state that there father, William Brickhouse published his will in 1825, appointing Gilbert Brickhouse his executor. The will bequeathed specific legacies and specified that the residue of the estate be divided among his four sons, Allen, Gilbert, Nathan & Joseph Brickhouse, viz. the negroes and their increase not theretofore bequathed in specific legacies. Petitioners show that said reidue consisted of eight negroes, men Jordan, Harry, Peter, & Dawson and women Clark, Dina, Rhoda & Jane. Petitioners being tenants in common with said Gilbert Brickhouse are desirous to have said negroes divided among them and pray the court will appoint three unconnected freeholders to make such division.

Court order January Term 1834 that Matthew Brickhouse, Jos. Alexander & George H. Alexander divide the negroes of Wm. Brickhouse among the heirs.

Division of the negroes of William Brickhouse on 5 February 1834:
Lot 1 - Jordan ($450) & Jane ($75) to Gilbert Brickhouse
Lot 2 - Harry ($425) & Rhoda ($150) to John A. Brickhouse
Lot 3 - Clark ($212.50) & Peter ($250) to Nathan Brickhouse
Lot 4 - Dorson ($250) & Dinah ($175) to Allen Brickhouse
Lot #1 pays #3 $21.87 and pays #4 $18.76
Lot #2 pays #4 $90.63

Bond dated 25 April 1838 in the amount of two thousand dollars appointing James Fagan guardian to Allen Brickhouse, John A. Brickhouse & William Norman securities. {The words orphan are struck out on this bond.}

Ward security; and also Priscilla Brickhouse to James Fagan on 12 Apr 1838.
