Ordered that Jos. Halsey, Samuel Rogers & Jos. Alexander audite and settle the estate of Allen Brickhouse with John Brickhouse administrator.

Bond dated 27 Apr 1840 in the amount of two thousand dollars appointing John E. Brickhouse administrator of the estate of Allen Brickhouse deceased, Abraham J. Swain & Richd. D. Hassell securities.

Petition July Term 1840 by John E. Brickhouse, appointed administrator of Allen Brickhouse deceased at the April Term 1840. He states that thev estate is in debt for up to $200 and there are little to no perishable assets to satisfy these debts, but there ia a nedro girl and boy that he has left his heirs at law, Nathan A. Brickhouse, John A. Brickhouse, the children of Gilbert Brickhouse deceased, Affa Brickhouse, Priscilla Fagan, wife of James Fagan, and the wife of your petitioner, Affa Brickhouse. Petitioner prays an order to sell the negros in order to pay the debts.


Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Priscilla Brickhouse to James Fagan on 12 Apr 1838; also Affa Brickhouse to John Brickhouse Jr. on 30 May 1825.

Allen Brickhouse was a son of William Brickhouse. See the 1825 will of William Brickhouse for more information.

The will of William Brickhouse cites a daughter Orpha Brickhouse. The above petition cites Affa Brickhouse twice as an heir, once as an unmarried woman and once as the wife of John E. Brickhose, the petitioner. Tyrrell County marriage bonds show the marriage of Orpha Brickhouse to Edward Halstead on 25 Feb 1842, after the date of the above petition. It is therefore apparent that the first Affa should have been Orpha, an understandable mistake by the lawyer writing the petition.
