In the name of my Heavenly parent Amen - I Nathaniel G. Brickhouse, being of sound mind and memory and in good health - Knowing the uncertainty of life and the certainty of death and being fully aware that it will soon be my lot to die & being desirous to provide for my beloved wife a competent living in this life - do make declare and publish this to be my last will and testament in words and figures as follows to wit -

Item. 1st. It is my will and desire and I so direct that my Executrix hereinafter to be named shall after my death give my body a decent & suitable burrial and pay all of my just debts out of the money - notes and personal property that may first come to her hands

Item. 2nd. It is my will and desire that my beloved wife Brittaney E. Brickhouse, shall have the use and benefit of all of my property of every kind and description for and during her natural life - for her sole & separate use and benefit so long as she shall live - I therefore loan to her all my estate & property of every kind, including all my real estate, personal, mixed and chattle property - also all money notes - and choses (?) in action, for and during her natural life - the use of the said property, and the rents and profits arising therefrom for the sole & separate use of herself so long as she shall live -

Item. 3rd. I give and bequeath the remainder in all of said property - to take effect after the death of my beloved wife to my dear little friend and relation Leatica D. Cahoon to her and her heirs in fee simple and forever - who is the daughter of Benjamin C. Cahoon

Item. 4th. I nominate and appoint my beloved wife Britaney E. Brickhouse Executrix to this my last will and testament and direct that she shall erect a suitable tomb-stone over my grave - out of any of the personal property that may come to her hands -

Item. 5. It is my will and desire and I so direct that after the death of my belved wife, that a suitable tomb-stone shall be erected over her grave and that a sufficient amount of the personal property belonging to my estate shall be sold to pay the expenses of the same -

Item. 6th. That in the event my beloved wife shall fail to erect a suitable tomb-stonen over my grave during her life - then it is my will and desire & I do so direct that a suitable tomb-stone shall be erected over my grave after her death & a sufficient amount of the personal property belonging to my estate be sold to pay the expenses of the same

Application for Letters Testamentary

To the Honorable the Superior Court of Tyrell County

The undersigned Brittanis E. Brickhouse respectfully showeth(?) unto the Honorable that her husband, the late N. G. Brickhouse died domiciled in said County on the 26th day of November 1889, leaving a last will and testament & appointing your applicant his Executrix, in which he gave to your applicant the use of all of his property for & during her natural life & the remainder over to Lethia D. Cahoon.

That at the time of his death he was the owner & in possession of the following property One tract of land where he resided - Value of $500.00 One mule - value of $75 - 2 cows & calves 5 hogs, 9 sheep, 1 Buggy, 1 cart, 1 chest & lot of mechanic tools, 2 plows, 3 hoes, 1 spade, 1 Briar Hook, 1 still and contents, 1 grind stone, 1 Turning Lathe, 1 plank & skiff, 24 shad nets 12 herring nets, 12 lbs net twine, 1 loom, 1 stove & contents, 3 beds & outfit 2 sets of chairs, 2 rocking chairs, 1 side board & contents, 1 bureau & wash stand, 1 machine, 3 follen leaf table, 4 plank tables, 1 double barrel gun, 2 clocks, 1 big wheel, 1 little wheel, 1 bed & 1 pair balances Total Value of all property $200.00

That your applicant is the proper party to qualify as Executrix on said estate by ? under will that your applicant & Lethia D. Cohoon are the only persons entitled to share the said estate under the will

That Lethia D. Cahoon is a minor and without General Guardian

Bretanis E. Brickhouse makes out in due form of law that the facts set out in the foregoing application of her own knowledge are true and those set out on in for motion & belief she believes to be true

County of Tyrrell - In the Superior Court

A paper writing purporting to be the last will and testament of N. G. Brickhouse decd is exhibited before me the undersigned Clerk of the Superior Court for said County by Brittainy E. Brickhouse widow and legatee of said N. G. Brickhouse and the due execution thereof by the said N. G. Brickhouse is duly proven by the oath of and examinations of E. V. Davenport and J. W. Sample the subscribing witnesses thereto, who being duly sworn doth depose and say, and each for himself doth deposeth and saith, that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of N. G. Brickhouse that the said N. G. Brickhouse in the presence of this deponant subscribed his name at the end of said paper writing which is now shown him and which bears date of April 26th 1884

And the deponant further saith that the said N. G. Brickhouse the testator aforesaid did at the time of subscribing his name as aforesaid declare the said paper writing so subscribed by him and exhibited to be his last will and testament and this deponant did thereupon subscribe his name at the end of said will, as an attesting witness thereto, and at the request of and in the presence of said testator.

And at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of said deponant subscribing his name as an attesting witness thereto as aforesaid the said N. G. Brickhouse was of sound mind and memory, of full age to execute a will and was not under any restrictions to the knowledge information or belief of this deponant. And further these deponants saith not.

I, Brittainy E. Brickhouse do solemnly swear (or affirm) that N. G. Brickhouse died leaving a Last Will and Testament; and that I will well and truly administer all and singular the Goods and Chattels, Rights and Credits of the said N. G. Brickhouse and a true and perfect inventory thereof returned as provided by law; and all other duties appertaining to the charge reposed in me, I will faithfully and honestly perform with the best of my skill and ability: So help me God.
