January Session 1827

Ordered that David M. Sergeant be appointed administrator on the estate of Levy Bateman deceased & that he enter into bond with security & that the sheriff let it out to the highest bidder to ? him with security & the proceeds (if any) to go to the use of the County, against which Jeremiah H. Phelps Esq. enters his protest also Matthew Brickhouse Esq..

April Session 1827

David M. Sergent administrator of Levi Bateman returned a note to creditors which was ordere to be filed. He also returned an inventory & account of sales of the estate.

Bond dated 24 Jan 1827 in the sum of three hundred dollars appointing David M. Sergeant administrator of the estate of Levi Bateman deceased, Wilson B. Hodges & Dempsey S. Godfrey securities.

Petition July Term 1828 by David M. Sergeant stating that Levi Bateman died seized and possessed of land in Tyrrell County. Petitioner is a creditor to the estate in the amount of sixty five dollars and thirty three cents and at a previous term of the court he took out administration upon the estate. The estate does not have sufficient assets to satisfy this debt. The heirs at law of Levi Bateman are Daniel Frances Elizabeth Hannah Joseph Seth Benjamin Martha, alias Patsy. Petitioner prays that a copy of this petition may issue returnable to next term against the said heirs and that guardians may be appointed to the infants and that a decree may be entered against the heirs for the amount of his demand and that execution may issue on said land belonging to and in the hands of said heirs. {This document is from the 1820 Levi Bateman estate file and is incorrectly filed there.}

Summons issued 29 Oct 1829 for Joseph Bateman to appear at the next term to answer charges of trespass by David M. Sergeant administrator of Levi Bateman with damages of $200.

Bail bond dated 9 Nov 1829 in the amount of four hundred dollars by Joseph Bateman to appear at the January term to answer the charges by David M. Sergeant, with Silvanus Armstrong security.

Finding dated 5 Nov 1830 by Samuel Davenport & Thomas B. Nicholls, arbitrators assigned to arbitrate and settle the suit between David M. Sargant administrator of Levi Bateman Junr. deceased, plaintiff, and Joseph Bateman defendant. They find from the evidence before them that Joseph Bateman is not guilty of using the property or breaking in upon the estate of said Levi Bateman Junr. deceased.


Transcriber's Notes:
The heirs of Levi Bateman Junr. are all children of Joseph Bateman in his 1839 will, making it apparent that he was also a son of Joseph Bateman. See the 1839 will of Joseph Bateman for further information.
