I, Chas. Bateman, of the aforesaid memory, but considering the uncertainty of my earthly existence, do make this My Last Will And Testament:

First: I give, devise, and bequeath to my beloved wife, Lois Bateman, for the period of her lifetime, all of my property which I may die seized and possessed of, whether real, personal, or mixed, and including money and chooses in actions. to have and to hold the same to her during her lifetime, for won use and benefeit, and with full authority to use, consume and expend so much thereof as she may deem necessary for the maintainance and support of herself.

Second: At the death of my beloved wife Lois Bateman, I direct and empower my Executor hereinafter named to sell all my land and chattle property, and collect all choses in action and debts to me owning - in fact to convert my entire estate into money- and out of the money thus collected together, to pay the legacies hereinafter specifically set forth.

Third: Out of the moneys gotten together by my Executor from the sale of my property re., I give and bequeath to my brother Gilbert Bateman, five hundred dollars. to my sister, Louisa Holloway, five hundred dollars. To my half sister, Pattie Hickey, five hundred. To my wife's son, Thomas M. Beasley, five hundred dollars. To my wife's son, John S. Beasley five hundred dollars. Should any of the legatees named in this clause of my Will die before I do, then it is my will and desire, that the child or children of such legatee as may die before I do, shall take legacy devised to the parent of such child, or children.

Forth: The rest and residue of the money remaining in the hands of my Executor, after paying the legacies provided in section Third hereof, I give and bequeath to the Trustees of the Missionary Baptist Church, (White) at Columbia, North Carolina, and to the Trustees of the Baptist Orphanage at Thomasville, N. C., One half to each share and share alike: the Trustees of the Missionary Baptist Church, (White) at Columbia, N. C. to use and expend the one half of the residue bequeathed to them for the benefeit of the Missionary Baptist Church (White) at Columbia, in such manner as they may deem best: and the Trustees of the Baptist Orphanage, at Thomasville, N. C., to use and expend the one half of the residue bequeathed to them in further(unreadable) of the plans and purposes of said Orphanage.

Fifth: I do hereby appoint and consitute my friend Mark Majette my Executor to execute this my last Will and Testament. I desire him, upon my death, to collect all the debts of all kinds to me owing and pay the money therefrom arising to my beloved wife, Lois Bateman, except so much thereof as may be necessary to pay any just debt by me owing at the time of my death, my burial expenses, and the cost of erecting a suitable Tombstone at my grave.

In testimoney whereof, I have hereunto set my hand and seal, this 17th day of February, 1906, hereby revoking, and declaring utterly void all Wills and Testaments by me heretofore made.

In the matter of Will of Chas. Bateman, Deceased.

The paper-writing hereto attached and purporting to be the last Will and Testament of Chas. Bateman, Deceased, is exhibited before the undersigned Clerk of the superior Court for Tyrrell County North Carolina by Mark Majette the Executor therein named for the purpose of proving the execution of said Will as by law provided and thereupon the following proof thereof is taken by the oath and examination of Mark Majette and Bettie S. Mayette the subscribing witnesses thereto as follows.

Mark Majette and Bettie S. Majette being duly sworn depose and say, and each for himself and herself deposes and says, that he and she is a subscribing witness to the said paper-writing now shown him and her purporting to be the last Will and Testament of Chas. Bateman, Deceased, and that he and she saw Chas. Bateman execute this writing as his last Will and Testament, and that he and she (Affiants) attested it in the presence and at the request of the said Chas. Bateman, Deceased, and in the presence of each other, and that at the time of its' execution the said Chas. Bateman was in his and hers, (affiants) opinion, of sound mind and desposing memory.
