September 8, 1793
In the name of God Amen. I Anne Burns of Tyrell County & state of North Carolina being weak in body but of perfect mind & memory thanks be given unto God for the same - do make & ordain this my last will & testament, that is to say - it is my desire and request that all my household goods, chattles and everything I ? of be sold at public vandue by my executor, for six months credit except such legacies as are hereafter mentioned and the monies rising therefrom after all my just debs are paid it is my will that the remainder be divided into three equal parts which said parts or parcels of monies I give devise & dispose of in manner and form following - that is to say -
Item - I give and bequeath unto my well beloved son John Swinson one third of the above mentioned monies, to him and his heirs forever -
Item - I give and bequeath unto my well beloved daughter Chloe Bembridge one third also of the above mentioned monies to her & her heirs forever -
Item - I give and bequeath unto my grand children Thomas, Anne, Archabel, Sarah, Elizabeth and John sons and daughters of Thomas & Hannah Stubbs, the other third of the above mentioned monies to them and their heirs forever -
Item - I give and bequeath unto my son Richard Swinson one shilling sterling, to him & his heirs forever -
Item - I give & bequeath unto my grand daughter Charlotte Jones one bed quilt to her & her heirs for ever -
Item - I give & bequeath unto my grand daughter Anne Stubbs one bed quilt to her & her heirs for ever -
Item - I give and bequeath unto Elizabeth, daughter of Everard & Elizabeth Stubbs one cow named Beauty & her calf - to her & her heirs for ever -
Item - I give and bequeath unto Christopher Duckett one ? ? bedstead, one bed bolster, pillows & full furniture for the same. Likewise all and singular my monies, bonds, notes and accounts that may be by or due to me at my death, to him and his heirs forever - and I do hereby constitute, make & ordain the said Christopher Duckett my only and sole executor of this my last will and testament and I do hereby utterly disallow, revoke & disannull all and every other testaments, wills & legacies, bequests & executors, by me in any ways before this time named, will'd and bequeath'd, ratifying and confirming this & no other to be my last will & testament, in witness whereof I have hereunto sett my hand and seal this eight day of September 1793 -

The last will and testament of Ann Burns was introduced in open court and proved by the oath of Michael King ordered to be recorded.
Personally appeared Christopher Duckett in open court and quallifyed executor to the last will and testament of Ann Burns deceased according to due form of law.
October Session 1798
Christopher Duckett executor of the last will of Ann Burns deceased returns in open court on oath an inventory of said estate ordered filed. {Inventory in estate records says Mrs. Ann Burns.}

also James Jones married Charlotte Bembridge on 12 Apr 1794, Thomas Stubbs Junr. security.
Ann Burns is the remarried widow of Richard Swinson who was deceased in 1770.
