April Session 1817

The last will & testament of Ruben Cohoon was exhibited in open court & proved by the oath of Thomas & Ebenezer Cohoon in due form of law.

Hannah Cohoon came into open court and quallified as executrix to the last will & testament of Ruben Cohoon in due form of law.

Ordered that Hannah Cohoon executrix on the estate of Ruben Cohoon sell the estate of said deceased agreeable to law & make return to the next term.

July Session 1817

The inventory of the perishable estate of Ruben Cohoon was returned on oath by Hannah Cohoon the executrix & filed.

April Session 1820

Hannah Cohoon was appointed guardian to Ruben Cohoon & Burton Cohoon & entered into bond with approved security ordered that she receive the estate of the said orphans into her possession & account for the same agreeable to law.

October Session 1822

Hannah Cohoon appeared in open court & renewed her bond as guardian to the orphans of Ruben Cohoon deceased & filed.

Bond dated 5 Apr 1820 in the amount of two hundred & fifty pounds appointing Hannah Cohoon guardian of Ruben & Burton Cohoon orphans of Ruben Cohoon deceased, Bennett Armstrong & William Cohoon securities.

To the Sheriff of Tyrrell County greetings.
Whereas Benjamin S. Clayton heretofore recovered against Hannah Cohoon executrix of Ruben Cohoon and William Cohoon the sum of four hundred and fifty three dollars and fifty five cents on judgement of the Court of Pleas & Quarter Sessions for Tyrrell County and on the trial of the issues it was then and there found by the jury that the said Hannah Cohoon executrix as aforesaid had no assets to satisfy the plaintiffs demand. And whereas also the said Hannah Cohoon and William Cohoon moved for and obtained an order of said court to annul the judgement aforesaid in said case. Whereupon the said Benjamin S. Clayton moved for and obained an appeal to the next Superior Court of Law for Tyrrell County and the record of said suit was transferred and certified to the said Superior Court in due form of law all of which appears to us of record. And whereas afterward to wit at March Term of the Superior Court of Law of Tyrrell County the same case on the appeal aforesaid came on to be tried and heard before the Honorable Mr. Judge of the Superior Court of Law then sitting and the reasons in annul was then and there over ruled and the verdict in the Court below was confirmed for the sum of four hundred and fifty three dollars and 55 3/4 cents against the defendants with costs of suit etc. and judgement rendered accordingly.
And whereas also execution issued from the said Superior Court of Law to levy the same judgement and costs of the recovery as aforesaid against the said William Cohoon and the Sheriff returned upon the same that there was nothing to be found of the said William Cohoon of which to levy said monies or any part thereof, all of which appears to us of record. And it being suggested to us that the said Ruben Cohoon the testator was seized and possessed at the time of his death of lands tenements and hereditaments that were sufficient and liable to satisfy the plaintiff's judgement and recovery aforesaid, and that the said Ruben Cohoon devised his said lands tenements and hereditaments to his widow, the said Hannah Cohoon, to his sons and heirs at law, to wit to William Cohoon, David Cohoon, Ebenezer Cohoon, Thomas Cohoon, Ruben Cohoon, & Burton Cohoon, an infant to whom the said Hannah Cohoon is guardian, and that they entered upon and took seizen and possession of their said devises under the said will.
And whereas also the said Ruben Cohoon left over and beside the sons named above who were heirs at law the following daughters to wit, Clarkey Jones, Elizabeth Clayton, Sally Clayton, wife of the plaintiff, & Polly Cohoon to whom in case the said Ruben Cohoon had not devised as aforesaid part of the said lands tenements & hereitaments, would have descended as heirs at law.
And whereas also the said Thomas Cohoon has since departed this life intestate and the lands tenements and hereditaments which were devised to him have descended to his brothers & sisters the said sons and daughters of the said Ruben Cohoon as aforesaid. And the said Benjamin S. Clayton having applied to us for his proper remedy in his behalf and we being willing that justice be done in the ? do command to summons the said David Cohoon, William Cohoon, Reuben Cohoon, & Burton Cohoon by his guardian, the said Hannah Cohoon devisees and heirs at law as aforesaid - and the said Clarkey Jones and the heirs of the said Elizabeth Clayton who is now dead having the following heirs at law to wit Polley, Sally & Asa Clayton, that they show cause at the next term of this court at Columbia at the court house on the first Monday of September next wherefore judgement should not be rendered against the real estate that was of the said Reuben Cohoon and the same made liable to pay the said Benjamin S. Clayton's judgement and recovery as aforesaid and that the said William Cohoon also show cause why the said judgement should not be recovered against him. And have you then and there this writ and how you have executed the same. Witness Robert Wynne clerk of our said court this first Monday of March at Columbia in the 49 year of our independence & in the year of our Lord 1825.

Issued the 8th, 1825.

Execution was issued in the above case on 1 Oct 1825 against the lands and tenements of Reuben Cohoon in the hands of his heirs David Cohoon, William Cohoon & Reubin Cahoon and Burton Cohoon & Polley & Sally Clayton & Asa Clayton and of Hannah Cahoon and the goods and chattels lands & tenements of William Cohoon.

There are many other documents relating to this suit, but none reveal anything of genealogical significance that is not already stated in the above summons.

There are also documents relating to Mary Spruill suing for recovery of a $50 debt.
