In the name of God Amen I John Caroon of the State of North Carolina and Tyrrel County being very sick and weake in body but of perfect mind and memory thanks be given unto God for it calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hand of almighty God that gave it and my body I recommend to the earth to be buried in a Christian like manner at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate where with it has pleased God to bless me in this life I give devise and dispose of the same in the following manner and form - - - - - - - -

First I give and bequeath to my well beloved wife Sary my manner plantation where on I now live likewise all the rest of my movable property with in and with of goods and chattles during her widowhood or life should she marry again that my movable property may be divided between my suceeding children - - - -

Item - I give to my son Thomas a certain parcel or track of land laying on Durins Island at the mouth of alligator containing five hundred and twenty acres to him and his heirs forever

Item - I give and bequeath unto my two sons William and Nevel the manner plantation where on I now live to be equally divided between them to them there heirs for ever likewise I constitute and appoint my two sons Joseph Caroon and John Caroon my only and sole executors of this my last will and testament and I do utterly disallow revoke and disannul all and every other former testaments wills legacies bequests and executors by me in any ways before named willed and bequeathed ratifying and confirming this and no other to be my last will and testament in witness whereof I have here unto set my hand and seal this second day of February in the year of our Lord one thousand seven hundred and ninety one

Petition January Term 1830 by Thomas Caroon who states that by the last will and testament of John Caroon his executors were Joseph Caroon & John Caroon who qualifed and took into their hands the property according to the will. The wife and the executors have since died without making final settlement and distribution of said estate. Petitioner at January Term 1830 applied for and received letters of administration de bonis non with the will annexed of John Caroon. Petitioner further shows that there is chattel property and negroes of considerable value undisposed of and not hitherto distributed in any way according to the intention of the testator or the interests of the parties concerned. Petitioner believes the debts of the estate have long since been paid and further shows that according to the terms of the will the legatees share equally in the estate. The distributees are numerous either in their own right or in the right of deceased children and it would be difficult if not impossible to make equal distribution, so the petitioner prays for a court order to sell the negroes and chattel property.

Bond dated 28 Jan 1830 in the amount of ten thousand dollars appointing Thomas Caroon administrator of the estate of John Caroon Senr. deceased, Ephraim Mann & Solomon Mann securities.
