I John Dunbar of the County of Tyrrell and State of North Carolin being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say.

First - That my executor and executrix hereinafter named shall provide for my body a decent burial suitable to the wishes of my relations & friends and pay all funeral expenses together with my just debts howsoever & whomsoever owing out of the money that may first come into his hands a part and parcel of my estate:

1 First - I give and devise to my beloved wife one horse named Davie one rockaway all my farming tools all my hogs all my cattle one wheat fan all my sheep and all the bees on this farm whereon I now live & all my household & kitchen furniture and all the grane that may be found on this place one seine and flat:

2 Second- I give and devise to my brother William Dunbar one certain piece of land lying in the County and State above named & on the New Lake bounded as follows: Beginning in a persimmon tree on the edge of the lake running due East to Franklin Dunbars line thence S. along sd. Dunbars line to Nancy Dunbars line thence to Nancy Dunbars corner thence S to my own line then with my own line due W to the lake thence the various courses of the lake to the first station containing thirty acres more or less & I further give & devise to my brother William Dunbar one horse named Jesse.

3 Third- I give and devise to my brother Franklin Dunbar one piece or pacel of land in the County & State aforesaid & lying on the New Lake beginning in my own back corner running with the canal N 55 E to a Maple thence N W to the next corner to a pine thence S 55 W to a sweet gum thence from the gum around to the first station containing one hundred acres.

4th - I give to my nephew John Dunbar one piece or parcel of land in the County and State aforesaid bounded as follows: Beginning on the Canal in a Black Gum S 10 E down to Fred Simmons line thence E to the corner a sweet gum thence N W to the Canal thence with the Canal up to the first station also one other piece on the other side of the Canal beginning in a Maple N W to Franklin Dunbars line thence with Franklin Dunbars line down to his corner a sweet gum thence up the Fence South Course to the Canal thence with the Canal to the first station containing one hundred and twenty five acres in both pieces & I also give and devise unto my nephew John Dunbar all my household & kitchen furniture all my farming tools all my cattle hogs sheep & bees and all the grain found on the plantation:-

5 fit - After the death of my beloved wife that part or portion given to her I give and devise all the property named to Amanda Melvina Hill wife of Benjamin Hill (Coloured) & to their heirs.

And lastly I do hereby constitute and appoint my beloved wife Hariet E. Dunbar executrix and my brother Franklin Dunbar my lawful executor to all intents and purposes to execute this my last will and testament according to the intent and meaning of the same & every part & clause thereof hereby revoking & declaiming utterly void all other wills & testaments by me heretofore made: In witness whereof I the said John Dunbar do herunto set my hand & seal this 7th day of December 1866 A D.

Signed Sealed Published & declared by the said John Dunbar to be his last will & testament in the presents of us who at his request & in his presents do subscribe our names as witnesses thereto.

A paper writing purporting to be the last will and testament of John Dunbar decs: is exhibited for probate in open court by Franklin Dunbar executor and Harriet E. Dunbar executrix therein named & the due execution thereof by the said John Dunbar is proved by the oath & examination of J.R. Norman & J.W. Hassell the subscribing witness. It is therefore considered by the court that the said paper writing and every part thereof is the last will and testament of the said John Dunbar & the same is ordered to be recorded & filed & thereupon the said Franklin Dunbar executor & Harriet E. Dunbar executrix duly qualified as such by taking the oath required by law.
