In the name of God: I Richard Davenport of Tyrrell County Planter being very sick and week in body but of perfect mind and me memory thanks be given to Almighty God therefore calling unto mind the mortality of my body and knowing that it is appointed for all men once to die I do make this my last Will and Testament that is to say principally and first of all I give and recommend to the executors nothing doubting but at the General Resurrection I shall receive the same again by Mighty power of God to bless me in this life I give demise and dispose of the same in the following manner and form,

Item- I give and bequeath to my eldest son John Davenport one hundred and twenty five acres of land which is already layed out by a line of marked tree for him and one iron pott.

Item- I leave and I to my son Jacob Davenport the use of the Manner plantation in which I live with the land belonging thereto containing one hundred twenty five acres during his natural life and after his decease I give and bequeath to his son Benjamin Davenport his heirs and assigns forever the afforesaid lands.

Item- I give and bequeath to my daughter Mary Mchabees heir one shilling and four pence sterling.

Item- I give and bequeath to my daughter Elizabeth Davis one shilling and four pence sterling.

Item- I give and bequeath to my daughter Anna Davis one shilling and four pence sterling.

Item- I give and bequeath to my daughter Susannah Caswell one shilling and four pence sterling.

Item- I give and bequeath to my daughter Rebekah Long one shilling and four pence sterling.

Item- I give and bequeath to my son Jacob Davenport one shilling and four pence sterling.

Item- I give and bequeath to John Davenport son Ezra Davenport one cow big with calf.

Item- I give and bequeath to Jacob Davenports daughter Sarah Davenport one bed and furniture and one cow and yearling.

Item- I give and bequeath to Jacob Davenports son Benjamin Devenport one bed and furniture and one cow and calf.

Item- I give and bequeath to my well beloved wife all the rest of my houshold goods and chattells wherever to be found during her life and after her decease if any be left to be equally divided between my two grand children Benjamin Davenport and Sarah Devenport.

Lastly I do make constitute and ordain my son John Davenport and John Davis to be whole and sole execators to this my last Will and Testament whom I do appoint and I do hereby revoke and make void disannul and disalow all former will or wills by me made and this only to be my last will and Testement as Witness my hand and seal this the twenty second day of November one thousand seven hundred and seventy & three.

The last will and testament of Richard Devenport was proved by the oath of James Devenport one of the witnesses thereto who swore that the testator was of sound memory at the time of making the same, John Davis one of the exors. quallifyed thereto, ordered that the Secretary have notice that letters testamentary may issue.

An inventory of the estate of Richard Devenport was returned upom oath by John Davis exor., ordered to be recorded.

An account of sales of the estate of Richard Devenport was returned by John Davis exor. ordered that the same be recorded.

October Session 1788

Ordered that John Davis executor of Richard Devenport deceased have leave to sell the perishable estate of Benjamin Devenport deceased son of said Richard deceased and make return to next court.

Petition January Term 1795 by Jonathan Phelps. Richard Davenport by his will dated 2 Nov 1773 divided unto John Davenport & Benjamin Davenport his grandson two certain adjoining tracts of land. John's part was layed off by a line of marked trees and Jesse Bateman purchased from Ezra Davenport son of John his part. Your petitioner married Sarah the sister of Benjamin Davenport who inherited the same on the death of Benjamin. The lines between your petitioner and said Jesse are now in dispute.
