"Col. Charles Spruill you will please take notice that I shall proceed to take the deposition of Joseph Phelps Esqr. at the
house of the said Joseph Phelps in the County of Washington on the 26 day of January in the year of our Lord 1813 between the
hours of 10 oclock in the fore noon & 6 oclock in the afternoon in the Hall room of said house in behalf of myself to be read in evidence
in the suit depending in the Superior Court for the County of Chowan wherein yourself is plaintiff & myself, administratrix of D.
Davenport decd, deft, pursuant to a commission for that purpose issued by the said court when and where you may attend to cross examine
if you chose -
January 12th day 1813
