March 24, 1824
In the name of God amen the 24th of March 1824 I Thos. Davenport of the county of Tyrrel in the state of North Carolina being very weak and sick but of perfect mind and memory thanks be to God for the same therefore calling to mind the mortality of my body and knowing that it is appointed once for all men to die, do make and ordain this to be my last wil and testament, that is first of all I give my soul to God that gave it, and my body I recommend to the earth to be buried in a Christian like manner at the discretion of my executors nothing doubting but at the resurrection I shall receive the same by the mighty power of God & as touching such worldly goods as it has pleased God to bless me with I give demise and dispose of the same in manner and form following viz. - -
Item I leave one negro boy by the name of March to be sold at the discretion of my executors to the best advantage - -
Item I lend to my dear and beloved wife Nancy Davenport one negro woman by the name of Lidia during her natural life - -
Item I lend to my wife Nancy Davenport three feather beds and furniture during her natural life and also one young mare and three cows and calves during her natural life -
Item I give and bequeath to my beloved daughter Nancy Davenport one feather bed and furniture to her and her heirs for ever - -
Item I give and bequeath to beloved son Thos. Davenport one three years old heiffer - -
Item I also lend to my beloved wife Nancy Davenport eight head of sheep three sows and pigs one bofat three chests six stool chears one wollen wheal two linin wheals two tables one loom and harness one hand mill one pair of flat irons one hackle one iron sieve two pair of cards all my farming utentials two good axes and two old ones also all the provisions on hand one looking glass all the crockery ware and kitchen furniture - -
My will and desire is that at the death of my wife Nancy Davenport all the part that is lent to her to be equally divided between my three children Nancy Davenport Thos. Davenport and Zillah Ann Davenport - -
I like wise constitute and appoint my beloved wife Nancy Davenport and John Mydyett Esqr whole and soles executors of this my last will and testament and I do utterly disavow revoke and discontinue all other wills legacys bequeaths willed or bequeathed and executors by me in any wise before made willed or bequeathed ratified and confirmed this to be my last wil and testament In witness whereof I the said Thos. Davenport have hereunto set my hand and seal the day and date above written

Tyrrell County Court of Pleas & Quarter Sessions
April Session 1824
The last will and testament of Thomas Davenport deceased was exhibited and proven in open court by the oath of Joseph Evans one of the subscribing witnesses who also swore that he saw Joseph Caroon the other subscribing witness sign the same as a witness thereto.
July Session 1826
Ordered that Samuel Spruill, Ephraim Mann Esqr. & Frederick Davenport & Joseph McClees be appointed auditors to settle the estate of Thomas Davenport and make report to the next term.
October Session 1826
Ordered that Saml. Spruill, Ephraim Mann Esqr. Frederick Davenport & Joseph McClees be appointed auditors to settle the estate of Thomas Davenport and make report to the next term.
