In the name of God, amen- I, Silas Davenport being of sound mind and memory, do make this my last Will and Testament; I recommend my soul to God who gave it.- as to such estate as he the God who made has blessed me with, I dispose of as follows-

First- I lend to my beloved wife Eliza during her natural life and widowhood the following property, namely the Mansion House and Plantation whereon I now live, with all the wood land thereunto belonging, one still, four negroes, named, Milly, Virgil, Annie and Ellin, and I also give to my beloved wife Eliza one mare called, Kate, all my stock of hogs, cattle, and sheep, all my crop, one bed and furniture, two trunks, one chest, all my farming tools, all my house hold kitchen furniture, all the provision on hand, one hundred dollars in notes, all the cash on hand-

Secondly- After the death or marriage of my wife Eliza, I give and bequeath to my two sons David and Isaac, H. Negro boy Virgil, woman Milly and child Ellin-

Thirdly- After the death or marriage of my wife Eliza I give and bequeath to my son Silas, one bed and its furniture.-

Fourthly- After the death or marriage of my wife Eliza I give and bequeath to my daughter Mary Eliza, negro woman Annis and increase-

Fifthly- After the death or marriage of my wife Eliza, I give and bequeath to my son Ebenezer, Pettigrew, the mansion house and plantation whereon I now live with all the wood land thereunto belonging-

Sixthly- After the death or marriage of my wife Eliza and after all my just debts are paid, I give and bequeath to my daughter Mary Eliza, and my son Ebenezer Pettigrew all my estate heretofore not allotted of in legacies-

Lastly- Having faith in my son Silas, I do constitute and appoint him my lawful executor to all intents and purposes, not doubting but what he will do those I have left behind me justice, this is all I ask, and I have no doubt but he will do justice, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made- In witness whereof, I the said Silas Davenport do hereunto set my hand and seal, the 27th Sept 1852-

Signed, sealed, published & declared by the said Silas Davenport to be his last Will and Testament, in presence of us, who at his request and in his presence do subscribe our names as witnesses thereto-

The within last Will and Testament of Silas Davenport was this day proved in open court- whereupon it appeared to the satisfaction of the court that Silas D. Davenport the executor therein named renounces his office & declines to act as executor. It is therefore ordered by the court that Eli Spruill be appointed administrator with the Will annexed who is qualified by taking the necessary oaths and entering into bond in the sum of six thousand dollars with Henry E. Lewis & Tully Davenport securities.
