In the name of God Amen, the twenty seventh day of January in the year of our Lord one thousand seven hundred and sixty eight, I James Everitt of the county of Tyrrell in the province of North Carolina being in perect mind and memory do make and ordain this my last will and testament in manner and form following, that is to say -

First and principally, I recomend my soul into the hands of almighty God who gave it me, and my body I commit to the earth, to be buried in a Christian like manner and as for such worldly estate whereon it hath pleased God to bless me with, in this life, I give and dispose of in manner and form following -

I will that all my just debts and funeral charges be first paid and satisfied -

Item I give unto my loving wife Ann Everitt a bay horse that I had of Sam. Humphries and her bridle and saddle and a fether bed and furniture to it - I also lend my loving wife Ann Everitt my plantation and the land belonging to it and the negros and horses and cattle and hoggs and a equal part of my movables during her widowhood and know longer Also I will and desire that my wife should pay or agree that my executors should pay unto my two youngest daughters Elizabeth Everitt and Sarah Everitt thirty pounds Virginia money a peace or each of them a young negro a peace to the value of thirty pounds Virginia money -

Item I give unto my daughter Mary Everitt part of a track of land that I bought of William Spikes it being cald the high hils a joyning of Jesse Johnson beginning on the creek at the mouth of the Cabin Branch thence running up the said branch to the Gum Branch to Johnsons line thence along his line to the creek thence the water cous of the creek to the first station I say to daughter Mary Everitt to her and her ares for ever -

Item I give unto my daughter Ann Everitt part of a track of land that I twook up on the Rocky Swamp with father two hundred acres be the same more or less a joyning of Wm. Price and Johnson beginning at William Prices corner tree thence running a long William Everitt Sen line to the head line thence a long the head line to Johnson line thence a long his line to Wm. Prices line thence a long his to the first station I lay to my daughter Ann Everitt to her and her airs for ever -

Item I give unto my daughter Elizabeth Everitt thirty pounds Virginia money or a young negro to the value of thirty pounds Virginia money I lay to my daughter Elizabeth Everitt to her and her ears for ever -

Item I give unto my daughter Sarah Everitt thirty pounds Virginia money or a young negro to the value of thirty pounds Virginia money I lay to my daughter Sarah Everitt to her and her ears for ever -

Item I give unto my son William Everitt my plantation and all the land thereunto belonging and all the rest of my land that I am now persest of with and all my negroes and all my my tools of all sorts I lay to my son William Everitt to him and his ares for ever -

Item I will and desire that if he should dy befor he coms of age that all that I have given my son William Everitt should be equally devided between the rest of my children Mary Everitt Ann Everitt Elizabeth Everitt and Sarah Everitt to them and their ares for ever - And all the rest of my estate of what kind soever I desire it may be equally devided amoungst my four daughters Mary Everit Ann Everitt Elizabeth Everitt Sarah Everitt and my son William Everitt to them and their ares for ever -

I will and desire that my executors should give my for daughter sufficient learning to read well and my son Wm. Everitt good learning to read and right and sifer as well a this contery can aford well and their schooling to be paid out of my estate

I likewise nominate constitute appoint my two brothers John Everitt and Samuel Turner Everitt and my wife Ann Everitt executors of this my last will and testament revoking disannulling and making void all other or former wills legacies by me heretofore maid ratifying and confirming this and no other to be my last will and testament, in witness whereoff I have hereunto set my hand and seal the day and date first mentioned

Personally appeared before the justices of our said court in oppen court Joshua Johnson and made oath on the Holy Evangelist of all mighty God that he hard & see James Everitt publish, pronounce & declare this writing to be and contain his last will & testament & seal and deliver the same and further saith he was of sound mind & memory & at the same time he see Jesse Johnson & James Everitt sign as witnesses & further saith not
