In the name of God amen: I, Thomas Hoskins of the state of North Carolina and County of tyrrell considering the uncertainty of this mortal life and being of sound and perfect mind and memory blessed be Almighty God for the same make and publish this my last Will and Testament in manner and form following. Viz:

First - I give and bequeath unto my beloved wife Mary Hoskins three negroes by the names of Adam Sara and Hannah the sorrel mare bridle and saddle her choice of one bed and furniture I lend to my beloved wife Mary Hoskins during her natural life one half of the plantation whereon I live to be equally divided giving her the part which is improved also two cows and calves forever and two saws and pigs all the crockery ware sex flag bottomed chairs ---

I give to my four grand children Eliza Rainbough Anne Rainbough Sarah Rainbough and William Rainbough of the Town of Edenton two negores Viz: Jenny and Jack them with the said Jennys increase to be equally divided amongst my four grand children when they come of age or marry ---

I give to my son in law William Rainbough two negroes Viz: Dinah and Grace which two negores the said Rainbough has sold the others given to my four grand children are still in his possession. I give to my beloved daughter Elizabeth Creecy four negroes Viz: Cate Silla Venus and Jim which negroes she has in possession to her her heirs and assigns forever. I give to my beloved son James Hoskins four negroes Viz: Darby Sall Annis & Dave which negroes he now possesses to him his heirs and assigns forever. Also blind Jinny and her youngest child by the name of Rose ---

I give to the lawful heir of my beloved son Thomas Hoskins who has departed this life the negro man Mingo he having sold, the other given him, to them their heirs and assigns forever.

I give and bequeath to my son Hardy Hoskins four negroes Viz: Daniel Jerry Rachael and Sam also the following lands one track by the name of the Iron Mine one other tract joining the land of James Dillin known by the name of the red oak ground and one undivided tract belonging between Robert Wynne and myself lying on the Albemarle Sound all in Little Allegator & also one be and furniture to him his heirs and assigns forever.

I give and bequeath to my beloved daughter Mary Murphy four negroes Viz: Chloe Tomboy Silvy and Stephen which negores she has now in her possession to her her heirs and assigns forever ----

I give and bequeath ot my beloved daughter Sarah Wynne four negroes Viz: Soloman Lucy Grace and Merrick which negres are now in her posssession to her her heirs and assigns forever.

I lend to my son in law Benjamin Lowry three negroes Viz: Quash Pleasant and Isaac during his natural life unless my son in law should have heir lawfully begotten of his body, then I give said negroes to him his heirs and assigns forever ---

I give and bequeath to my beloved son Charles Hoskins the plantation whereon I now live with all the lands and swamp adjoining, And I do hereby autherize my executors to this my last Will, should they think it most advisable to sell all the said lands and swamp in the kistrict of Gum Neck and make use of the money arising therform of said land to purchase other land out of the said district of Gum Neck for my son Charles Hoskins and in case my son Charles Hoskins should die before he comes to lawful age or marry my will is that his land be sold and equally divided amon James Hoskins Hardy Hoskins and Anne Hoskins or the suvivor should any die. And I hereby authorize my executors to make sale of the following negroes Viz: Old Jim & Venus his wife and old Darby and Cate his wife, Should the sale of the perishable part of my estate and the land not memtioned be found insufficient ot discahrge all my debts which I desire to be justly paid and should there be any money remaining that arise form the sale of the above mentioned negroes after paying all my jsut debts I leave it to my daughter Ann Hoskins ---

I give and bequeath to my son Charles Hoskins and my daughter Anne Hoskins all the residue of my estate real and personal to be equally divided between them when they come to lawfull age or marry, And I hereby constitute and appoint my thiree sons James Hoskins Hardy Hoskins & Charles Hoskins my whole and sole executors acknowledgeing this to be my last Will and Testament revoking all others by me made In witness wereof I have hereunto set my hand and seal this 16th day of July Anno Domini 1804.

July Session 1804

The last will and testament of Thomas Hoskins Senr. was proved in open court by the oath of Robert Sawyer & filed.

James Hoskins Esqr. returned in court on oath the inventory of Thomas Hoskins Senr. deceased filed.

October Session 1804

James Hoskins Esqr. & Hardy Hoskins quallified as executors to the last will and testament of Thomas Hoskins Senr. deceased agreeable to law.

January Session 1805

Ordered that James Hoskins be appointed guardian to Charles Hoskins & Ann Hoskins orphans of Thomas Hoskins Senr. deceased and hath given bond in the sum of five thousand pounds Joseph Ansley & Zebulon Tarkinton securities.

July Session 1805

James Hoskins Esqr. returned in court on oath an account of sales of part of the property of Thomas Hoskins Senr. deceased amount 4 pounds, 11 shillings & 7 pence.

November Session 1808

Ordered that Jno. A. Patrick Esqr. Jno. Livermon Junr. & Joseph White be appointed to divide the negroes belonging to Charles & Ann Hoskins orphans of Thomas Hoskins Senr. deceased and make returns to next court.

February Session 1809

John A. Patrick Esqr. returned in court the division of the negroes between Charles and Nancy Hoskins filed.
