Tyrrell County Court of Pleas & Quarter Sessions


April Session 1826

Ordered that James A. Spruill be appointed guardian to James Lawrence & Ann Eliza Spruill two of the heirs at law of Fanny Spruill late Fanny Hathaway & that he enter into bond of $4000 with Jese Spruill & Alexander Dillon as his securities.

Ordered that Burton Hathaway be appointed guardian to Woolsey Joseph William B. Benjamin C. Hathaway heirs at law of Fanny Hathaway late Fanny Spruill & that he enter into bond of $4000 with Wilson B. Hodges & Henry Alexander his securities.

April Session 1828

Ordered that Jos. Hallsey, Danl. N. Bateman & William Spruill be appointed to divide the negroes belonging to the heirs of Fany Hathaway viz. Jos. Hathaway, Wm. Hathaway Jr., Benj. Hathaway, James Lawrence & Ann Eliza Spruill.

July Session 1828

James A. Spruill returned the division of the negroes of Fanny Hathaway among the heirs at law.

January Session 1830

An account of sale of the negroes Jack, Ishmael & Betty of the estate of Mary Wood for a division amongst the children of Fanny Hathaway was returned into court & ordered to be recorded.

An account of the hire of the negroes of Jos. Wm. & Benjamin Hathaway for the year 1830 was returned in this court.

January Session 1833

Jos. Halsey returned into open court an account of the hire of the negroes of Benj. Hathaway for the year 1833 amount $55.90.

Court order April Term 1828. Ordered that Jos. Halsey, Danl. N. Bateman & William Spruill be appointed to divide the negroes belonging to the heirs of Fanny Hathaway to wit Joseph, William & Benjamin Hathaway and James Lawrence & Ann Eliza Spruill.

Division of the negroes belonging to the estate of Fanny Hathaway returned July Term 1828:
Joseph Hathaway drew {torn - Miles & Lydia ?} - Lot No. 4 valued at $250
William Hathaway drew Osborn and old Ned - Lot No. 5 valued at $175
Benjamin Hathaway drew March & Charles - Lot No. 1 valued at $325
James L. Spruill drew Winey & Chloe - Lot No. 2 valued at $325
Ann Eliza Spruill drew boy Ned - Lot No. 3 valued at $200
Total valuation of $1275 divided by 5 = $255 per share
Benjn. Hathaway pays to Wm. $70
Jas. L. Spruill pays to Wm. $10
Will Hathaway Lot No. 5 - $175
Total is $255
James L. Spruill pays to Ann Eliza $55
Ann Eliza's share No. 3 - $200
Total is $255
James L. Spruill pays to Joseph Hathaway $5
Joseph Hathaway share Lot No. 4 - $250
Total is $255

The file contains several promissory notes and documents related to suits to recover these debts which show that Joseph Halsey & James A. Spruill were guardians of the children of Fanny Hathaway. One names Joseph Halsey as guardian of Benjamin Hathaway.
