Hazleton at January Term 1850, entering into bond in the amount of $4,000 with S. S. Simmons & Joseph McClees who have since died and Henry McClees & William McClees his sureties. By virtue of said appointment the said guardian took into his possession about $2,000 in property which he has continued to retain, so far as the same has not been wasted or destroyed by him. After three years said guardian failed to renew his bond and notice was issued, but he has failed and refused and still fails to renew his guardianship or give another guardian bond as required by law. The said Charles McClees is still continuing to hold his office as guardian and the said heirs are still under age and their estate is in danger of being wasted and lost. The said Charles McClees has now become liable to forfeiture of his office as guardian, to come to account with this orator and delivery and payment of the same. Orator prays a State's writ of subpoena be issued to Charles McClees guardian and Henry McClees & William McClees, executors of Joseph McClees, to appear at the next term of this court and answer this petition.
