I, William H. Johnson of the county of Tyrrell and state of North Carolina being of sound mind and memory, do make and declare this my last will and testament in manner and form following.

Item I. That my executors hereinafter named, shall see that my body is properly buried in accordance with the wishes of my family, and that my said executors shall pay my burial expenses together with all my just debts out of the first money that may come to their hands belonging to my estate.

Item II. I give and bequeath to my beloved wife Matilda one bed, bedstead and fixtures, one cow and calf, one table, one set of chairs, one clock, one looking glass, one lounge and one set of and irons my beloved wife taking the first chois of the above named articles. I also give my beloved wife Matilda one cook stove and all fixtures to the same belonging, and one set of tongs and shovels, also all the crockry ware and lamps that I may have on hand at the time of my death also all the knives and forks and spoons that I may have at my death, also one rocking chair.

Item III. I give bequeath and divise unto my two sons, John E. and Charles R. Johnson the sum of six hundred dollars to be held in trust by them for my beloved wife Matilda, they are to let said six hundred dollars out at interest at the rate of eight per cent per annum and to pay said interest annually to my said wife it being forty eight dollars per year during her natural life, and at the death of my said wife Matilda said six hundred dollars is to revert to my estate and to be applyed as herein after directed.

Item IV. I give devise and bequeath to my beloved wife Matilda during her natural life all the cleared land on the south side of the main road, with the privelege of fire wood out of the wood land, said cleared land being known as the manor place. My said wife is to have the privelege of having rail timbers out of or from the wood land as well as fire wood. The above bequeathes to my said beloved wife is to be in full against all claims that she may have on my estate by reason of her dower interest, or years provision, or any and all contracts or ? whatsoever.

Item V. I give and devise unto my sons John E. and Charles R. Johnson one third of my entire estate to be held by them in trust for the sole use and benefit of my beloved daughter Missouria Dillon during her natural life and at her death said amount so held by said John E. and Charles R. Johnson to revert to my estate and to be apply as herein after directed. Said John E. and Charles R. Johnson are to let said one third of my said estate out at interest and to apply said interest arising therefrom together with such portion of the principal as they in their judgement may deem proper to the suport and maintenance of my said daughter Missouria during her natural life.

Item VI. I give and devise unto my two sons John E. and Charles R. Johnson and their heirs and assigns ? all the balance of my estate of every nature and kind whatsoever including the principal of the six hundred dollars named in the third item of this my last will and testament also all the balance of the account of the one third held by them in trust for my daughter Missouria at her death to be by them equally divided between each other, so that they shall share and share alike equally that is to say that said John E. and Charles R. Johnson shall have a one half each of my intire estate subject to the above bequeaths.

Item VII. I hereby constitute and appoint my beloved sons John E. and Charles R. Johnson my true and lawful executors to this my last will and testament to execute the same according to the true intent and meaning thereof and in no case are they to be required to give any bond, either as executors or as trustees for the purpose of executing the trusts ? in item by any clause of this my last will and testament.

In witness whereof I have hereto set my hand and affixed my seal this 19th day of September A.D. 1891.

This day was duly exhibited before me a paper writing purporting to be the last will and testament of William H. Johnson deceased who died domiciled in said county on the 20th day of June 1893 which said paper writing was duly proved by the oath and examination of Arthur Spruill and R. M. Holloway the subscribing witnesses thereto to be the last will and testament of said testator William H. Johnson decd. It is further ordered that the same be admitted to probate and duly recorded and that letters of testamentary be issued to Jno. E. and C. R. Johnson the executors therein named.
