Lockhart, Thomas, 1779


Petition in October Term of 1801 by Joshua Hassell & Elizabeth his wife and Elisha Davis & Jemima his wife. Thomas Lockhart died intestate on or about 179 {this apears to be an unknown year in the 1790s} possessed of a considerable estate and leaving petitioners Elizabeth & Jemima his only issue. Administration on the estate of Thomas Lockhart was granted to John Warrington who thereupon took into his possession the estate of Thomas Lockhart. John Warrington also died in 179 {this apears to be an unknown year in the 1790s} leaving a will, of which Thomas Warrington was appointed executor. Your petitioners were both married in 179 {this apears to be an unknown year in the 1790s}. Your petitioners applied to John Warrington during his lifetime and to Thomas Warrington after the death of the said John to settle the said estate.

There is a copy of the above petition that uses the year 1779 instead of 179.

Summons dated 27 Oct 1801 and issued 8 Dec 1801 directed to the Sheriff of Pasquotank County for Thomas Warrington to appear at next court to answer questions about what he may know of his father's administration on the estate of Thomas Lockhart deceased.

Summons dated and issued on 27 Apr 1802 for Thomas Warrington to appear at next court to answer questions concerning what estate he may have in his hands of Thomas Lockhart deceased.

Summons dated 27 Jul 1802 and issued 8 Dec 1802 directed to the Sheriff of Pasquotank County for Thomas Warrington executor of John Warrington deceased to appear at next court to answer questions about what he may know of his father's administration on the estate of Thomas Lockhart deceased. Plaintiffs are Joshua Hassell and wife and Elisha Davis and wife, heirs of Thomas Lockhart.


Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of Elisha Davis to Jemima Lockhart on 5 Jan 1784, Joseph Wyatt & Stephen Swain securities; also Joshua Hassell married Elizabeth Lockhart on 3 Jul 1786, John Tarkinton Jr. security. The will of John Warrington was proved in July Term 1798. It is my opinion that 179 was entered as an unknown year in the 1790s and not 1779. It is highly unlikely that the heirs of Thomas Lockhart would have waited from 1779 until 1801 to recover their share of the estate. In addition, there are no court minutes from 1794 to 1798, and this is probably why there are no other references to the estate of Thomas Lockhart.
