Petition
H. W. McClees most respectifully showeth unto the court,
I. That his wife Lola O. McClees late of said county state & domiciled in said county died sometime during the month of December A. D. 1895. After having made a last will and testament on the 22nd day of February 1889 and deposited the same with your petitioner for safe keeping where it has ever since remained and is now produced to the court.
II. That said Lola O. McClees the testatrix in said will died possessed of real and personal property same is worth about eight hundred $800 dollars.
III. That H. W. McClees your petitioner is sole legatee under said will.
Wherefore your petitiooner paryes the ocurt that siad last will and testament of said Lola O. McClees be aqdmited to probate and that letters testamentary be issued to your petitioner upon said estate.

A paper writing without subscribing witnesses purporting to be the last will and testament of Lola O. McClees deceased is exhibited for probate in open court by H. W. McClees and it is thereupon proved by the oath of the said H. W. McClees that said last will and testament was deposited with him for safe keeping where it remained until the decease of the testator and until it was presented in open court for probate and it is further proved by the oath and examination of three competant and creditable witnesses to wit. T. L. Jones, J. J. McClees and M. E. Spruill that hey are acquainted with the hand writing of the said Lola O. McClees having ofter seen her write and very believe that the name of the said Lola O. McClees subscribed to the said will and the said will itself and every part thereof is in the hand writing of the said Lola O. McClees. It is therefore considered by the ocurt that the said paper writing is the last will and testament of the said Lola O. McClees and the same is ordered to be recorded and filed.
