January Session 1834

Ordered that Fanny Midgett widow of Jos. Midgett be permitted to administer on the estate of her deceased husband with Ephm. Mann, H. G. Spruill & Jeremiah Weskett securities.

Ordered that Fanny Midgett administratrix of Jos. Midgett have leave to sell the perishable estate.

Ordered that H. G. Spruill, Jos. McClees & Charles Spruill lay off to Fanny Midgett widow of Jos. Midgett her years allowance out of her husbands estate.

Ordered that H. G. Spruill, Jos. McClees & E. Mann lay off to Fanny Midgett her years allowance out of her husbands estate.

Also the years allowance of Fanny Midget widow of Jos. Midget was returned into court.

Bond dated 27 Jan 1834 in the amount of three thousand dollars appointing Fanny Midyett administratrix of the estate of Jos. Midyett deceased, Ephm. Mann, Hez. G. Spruill & Jeremiah Weskett securities.

Laying off of the years allowance to Fanny Midyett widow of Joseph Midyett deceassed on 8 Feb 1834 by Ephraim Mann, Joseph McClees & H. G. Spruill.

Petition October Term 1835 by Fanny Midyett who states that she is the widow of Joseph Midyett deceased who died leaving heirs your petitioner & Rhoda & Ann Midyett his infant daughters and that since the said Rhoda has died. Your petitioner and said Ann an infant of tender years are thereby tenants in common of all the negroes of which said Joseph died possessed and there are now thirteen of various ages. Petitioner is desirous of having them divided and prays that commissioners be appointed.

Division of the negros belonging to the estate of Joseph Midyett on 31 Dec 1835 by H. G. Spruill, Wm. Mann, Jos. McCleese & Benjamin Spruill.
To Fanny Midyett widow of the said Joseph:
Negro woman Mourning valued at $500.
Negro boy Henry valued at $400.
Negro boy Abel valued at $350.
Negro girl Viney valued at $450.
Negro girl Annis valued at $200.
Total value $1900.
To Ann Midyett daughter of Joseph Midyett:
Negro man Tom valued at $600.
Negro woman Peggy and child Truxton valued at $600.
Negro Elsey valued at $350.
Negro George valued at $200.
Negro Sabra valued at $150.
Total value $1900.

Bond dated 26 Jan 1836 in the amount of four thousand dollars appointing George H. Alexander guardian of Ann Midyett orphan of Joseph Midyett deceased, Jos. Alexander & Hez. G. Spruill securities.

Bond dated 23 Jan 1837 in the amount of four thousand dollars appointing Lemuel Basnight guardian of Ann Midyett orphan of Joseph Midyett deceased, Wm. Mann & Mathew Brickhouse securities.

Division on 8 Sep 1841 of the lands of Joseph Midyett deceased to Thomas B. Midyett & Benjamin Spruill and wife Nancy being the heirs at law of John Midyett deceased being entitled to over 27 acres and Samuel Alexander & John McClees and wife Mary Ann being the heirs at law of Rhoda Midyett deceased being entitled to over 35 acres, the whole quantity coming to 63 acres.
A parcel containing over 13 acres was allotted to Benjamin Spruill and wife Mary.
A parcel containing over 20 acres was allotted to Samuel Alexander & John McClees and wife Mary Ann in joint stock.
A parcel containing over 13 acres was set off to Thomas B. Midyett.
A parcel containing over 15 acres was set off to Samuel Alexander & John McClees and wife Mary Ann in joint stock.
Commissioners were Jeremiah Weskett, James I. Pledger, Abraham Pledger, Reddick Alexander & John H. Combs.

Bond dated 24 Jul 1848 in the amount of eight thousand dollars appointing Benjamin Spruill guardian of Ann Midyett with Jesse McClees & J. A. Spruill securities.

Account of sales of Ann E. Midyett land on 1 Jul 1851 by Samuel Leigh master in equity. Paid to Benjamin Spruill guardian. Sale brought $323.33 plus $50.65 in interest and minus $9.34 commission for a net of $364.64.


Transcriber's Notes:

Tyrrell County marriage bonds show the marriage of Joseph Midyett to Fanny Basnight on 26 Jul 1825, John Thoroughgood security; also Fany Midgett to Baily Rogers on 21 Jul 1836, Abraham Pledger security.

In the division of the lands of Joseph Midyett in 1841 see the estate of Samuel Midyett in 1815. John, Joseph & Rhoda Midyett are listed among his children. The will of John Midyett in 1832 lists his children as Thomas B. Midyett and Nancy S. Midyett. Nancy Midyett married Benjamin Spruill on 28 Apr 1835. Rhoda Midyett married Edmund Alexander on 8 Feb 1819. Samuel Alexander died in 1830 and his estate records show his children were Samuel and Mary Ann Alexander and that Mary Ann apparently married John McClees. Rhoda subsequently remarried to Abner Alexander on 4 May 1832. So everyone receiving land from the estate of Joseph Midyett in 1841 was a descendant of Joseph's brother John Midyett or his sister Rhoda Midyett. This would normally indicate that all of Joseph's children are deceased, but there is no evidence that his daughter Ann has died.
