Tyrrell County Court of Pleas & Quarter Sessions


October Session 1815

Ordered that Mrs. Nancy Midgett have leave of administration on the estate of Samuell Midgett deceased and gives for security Samuell Spruill and Thos. Leigh Esqrs. in the sum of five thousand pounds.

Ordered that Thos. Leigh Esqr. Henry Alexander Senr. Leml. Basnight Danl. Sawyer & Paul Thorogood Esqr. lay off to Nancy Midgett widow of Saml. Midyett deceased her year allowance agreeable to law and make returns to next court.

Ordered that Nancy Midgett administratrix on the estate of Saml. Midyett deceased have leave to sell the perishable estate of said deceased & make return to next court.

January Session 1816

Thomas Leigh Esqr. returned into court the inventory and account of sales of Saml. Midgett deceased.

Thomas Leigh returned into the years allowance of Mrs. Ann Midgett widow of Samuell Midgett deceased.

April Session 1816

Ordered that Ann Midgett widow of Samuel Midgett deceased be allowed the sum of fifty four dollars and eleven cents in part of her years allwance.

October Session 1816

Ordered that Nancy Midyett be appointed guardian to her two children Rhoda & Joseph Midyett & has entered into bond in the sum of three thousand dollars Saml. Spruill & Jno. Midyett securities.

January Session 1817

A division of the negroes belonging to the estate of Saml. Midyett was returned to court & filed.

July Session 1817

Ordered that Col. Danl. Sawyer, Robert Pledger Esqr. & Ava Smith Esqr. audite & settle the estate of Samuell Midyett deceased and make return to next court.

October Session 1817

The audited account of Saml. Midgett deceased was returned to court by Rob. Pledger Esqr. & filed.

Ordered that Paul Thoroughgood Robert Pleger & Henry Alexander Junr. divide the ballance of the estate of Samuel Midyett deceased amongst the heirs & make return to next court.

January Session 1818

The division of Samuell Midyets land in Little Alligator was returned into court by Rodger Snell and ordered filed.

The accounts of Ann Midyett guardian to Joseph and Rhoda Midyett orphans of Saml. Midyett was returned into court ordered filed.

January Session 1820

Thomas Leigh guardian to Joseph Midyett orphan of Saml. Midyett returned in open court his guardian account with a balance due said orphan $362.54 cents proved & filed.

April Session 1821

Thomas Leigh guardian to Joseph Midyett & William Alexander returned in open court on oath his guardian accounts & filed.

April Session 1822

The following guardians appeared in open court & renewed their guardian bonds agreeable to the act of assembly in that case made & provided as follows viz. - -
Thomas Leigh guardian to Joseph Midyett

January Session 1823

Edmund Alexander was appointed guardian to Joseph Midyett who entered into bond with approved security ordere that he recieve the estate of the said Joseph Midyett into his possession & account for the same agreeable to law.

Ordered that John Thoroughgood Joseph McClees & Henry Alexander be appointed commissioners to audite & settle the estate of Joseph Midyett between Thomas Leigh former guardian & Edmund Alexander present guardian & make report to next term.

July Session 1824

The account of sales of the hire of negroes and rent of land belonging to Joseph Midyett was returned in open court by Edmd. Alexander.

Bond dated 9 Oct 1815 in the amount of two thousand pounds appointing Nancy Midyett administrator of the estate of Samuel Midyett deceased, Samuel Spruill & Thomas Lee Esquires securities.

Bond dated 14 Oct 1816 in the amount of three thousand dollars appointing Nancy Midyett guardian of Rhoda & Joseph Midyett orphans of Samuel Midyett deceased, Saml. Spruill & Jno. Midyett securities.

Petition October Term 1816 by Nancy Midyett widow of Samuel Midyett who died in 1815 leaving considerable property and no will. Heirs at law are your petitioner, Nancy Midyett, Zilla Pledger, John Midyett, Nancy Pledger, widow of Joseph Pledger, Rhoda Midyett & Joseph Midyett. Requests a court order to divide the property among the legal heirs.

Division of the negroes of Samuel Midyett among the heirs according to petition and completed 6 Jan 1817. Total valuation of $1575, resulting in a share of $262.50 for the widow, Ann Davenport, John Midyett, Zillah Midyett, Rhoda Midyett & Joseph Midyett. Valuation and division as follows:
Harry valued at $300 to the widow, who pays $37.50 to Rhoda Midyett
Lydia valued at $325 to Ann Davenport, who pays $62.50 to Rhoda Midyett
Boson valued at $425 to John Midyett, who pays $12.50 to Rhoda Midyett and $150 to Joseph Midyett
Lewis valued at $275 to Zillah Pledger, who pays $12.50 to Joseph Midyett
Sabra valued at $150 to Rhoda Midyett
Peggy valued at $100 to Joseph Midyett

Court order October term 1817 for the divison of a 40 acre tract adjoining the lands of Saml. Spruil Esqr. & William Dowdy, the property of Saml Midyett deceased amongst the heirs of said deceased viz. Jno. Midyett Zilla Pledger Nancy Davenport Rhoda Midyett & Jos. Midyett and make return to next court.

Division 6 Nov 1817 of the balance of the estate of Samuel Midyett deceased. Audited account shows a balance of $936.43 due the estate, leaving $156.07 1/6 each to the widow, Zillah Pledger, John Midyett, Ann Davenport, Rhoda Midyett & Joseph Midyett.

Division on 7 Nov 1817 of the above land among the above heirs. Filed January term 1818.
