In the name of God Amen. I Ann Marriner of the state of North Carolina & county of Tyrrell, knowing that it is appointed for a mankind to die, do make this my last will and testament. Imprimis, I give my soul to God who gave it, & my body to the earth, to be decently buried in Christian like manner by my executors hereafter named. First it is my will & desire that the profits arising from my estate shall be equally divided amongst the whole of my children untill my daughter Martha should marry or come to lawful age then I wish my property to be equally dived amongst all my children except one hundred dollars each to be paid to my daughter Martha & son Lafayette Trustee Johnson by my executors at time of the division, more than any than any of the other children has. And lastly I nominate and appoint my son Joseph & brother Edmond Alexander to be my executors. In witness where of I have set my hand and seal this 14th day of November 1825.

January Session 1826

The will of Ann Marriner deceased was exhibited in open court and proven by the oath of Jno. Haughton who swore that at the time of signing she was of sound disposing mind and memory and at the same time Edmund Alexander came into open court & was duly qualified as executor thereto ordered that letters testamentary issue to him.

October Session 1827

Ordered that Eph. Mann, Jno. Midgett & Jos. Midgett audite & settle the estate of Ann Marriner with the executor.

July Session 1828

Ordered that Eph. Mann, Henry Alexander & Lemuel Basnight audite and settle the estate of Ann Marriner deceased with the executor Edmon Alexander.

January Session 1831

Jno. Haughton Esqr. returned into open court the division of the negroes of Jesse Alexander & Ann Marriner amongst the heirs.

Petition 25 Oct 1830 by Joseph Alexander, George H. Alexander, Thomas H. Alexander, Charles T. Spruill in right of his wife Martha and Abner Alexander by his guardian Edmd. Alexander, representatives and heirs at law of Ann Marriner, requesting division of the negroes belonging to the estate of said Ann Marriner, namely Cooper, Vilot, Ferebee, Beck & Jerry.


Transcriber's Notes:
The name "Layayette Trustee Johnson" may be in error. There is a later estate file for a "Lafayette J. Marriner" and this could be what was meant. It could also mean the son Lafayette whose trustee was Johnson.
There is a marriage bond for Ann Alexander to John Marriner on 28 Aug 1823, John F. Niel security. In as much as it seems Ann Marriner was previously married to an Alexander, this marriage to John Marriner should be her.
See the court minutes and estate papers of Jesse Alexander who died in 1818. His wife was Ann Alexander and his children's names match those of this Ann Alexander. Slaves names also match those divided to Ann Alexander from the estate of Jesse Alexander.
