It is my will and desire that after I am dead that Capt. W. W. Walker take charge of all my estate of every description and settle the same and after paying all my debts the balance I want him to pay over to my wife Sarah E. Morton. And Capt W. W. Walker is to take charge as aforesaid and give no bond but do all things as he would for himself. Witness October 30th 1880

The annexed paper writing purporting to be the last will and testament of Eugene Morton is exhibited in the Probate Court of Tyrrell County by W. W. Walker for Probate with said W. W. Walker appointed therein as executor and with M. D L Newbery and R. I. Hassell as witnesses thereto who being duly sworn each for himself deposes and says as follows viz the said M D L Newbery says that he signed said will in the presence of and at the request of said Eugene Morton and that in his presence he saw the said Eugene Morton sign the same. And declare it to be his last will and testament. And that the said R. I. Hassell on oath says that in the presence of and at the request of said Eugene Morton he signed said paper writing or will and the said Morton in the presence of the said Hassell declared the same to be his last will and testament for the purposes therein expressed.
