In the name of God Amen: I John Nichols being of sound mind and memory do make and declare this to be my last will & testament.

Item lst- I give to my son John Nichols ten dollars.

" 2- It is my will and desire that after all my debts are settled that my wife Deborah Nichols to remain in the possession of the balance of my estate during her life.

Itm-3- After the death of my wife I give to my daughter Nancy Nichols all my property which consist of house hold & kitchen furniture stock farming & carpenters tools.

4 - I hereby appoint and constitute Benjamin Spruill my whole and sole executor of this my last will & testament.

In witness whereof I have hereunto set my hand and seal this 2 day of Sept. A D 1865.

Then was this within paper writing purporting to be the last will and testament of John Nichols decs,d exhibited in open court for probate by Benjamin Spruill the executor therein named and the due execution thereof by the said John Nichols proved by the oath of and examination of Leml. Basnight & A. A. Combs the subscribing witness thereto whereupon it is considered and adjudged by the court that the said paper writing and every part thereof is the last will & testament of said John Nichols decs,d & it is ordered that the same be recorded & filed & Benjamin Spruill the executor therein named comes in to open court and is qualified as such by taking the oath required by law. Ordered by the Court that this probate with the will be recorede.
