In the name of God Amen. I William Neal of Tyrrell County in the state of North Carolina being weak in body but of sound and perfect mind and memory blessed be almighty God for the same do make this my last will and testament in manner and form following that is to say, I leave to be sold two pieces of juniper swamp containing twenty five acres apiece laying on the east and south side of the Grape Tree Point up the river also my young sorrill horse to be sold at the descretion of my executors and the money arising to discharg my debts and the overplus to go to the use of my family

Item I give and bequeath unto my two sons Aaron Neal and William Neal five hundred and twenty acres of land lying between Joseph Volivys land Ephraim Powers land and the north west fork to be equally devied between them, to them and their heirs for ever, but if either of them should die without heir lawfully begoten of his body that then the surviver to heir the others part

Item I give and bequeath unto my two sons John Neal and Jaconias Neal one hundred acres of land withe plantation whereon I now dwell to be equally divided between them, except use of said land dureing my wifes widowhood, but if either of my two sons John or Jaconias die without heir lawfully begoten of his body my will is that the surviver shall heir it I give and bequeath unto my son John Neal one hundred acres of juniper and cypress swamp lying at the mouth of the northwest fork on the north side of sd fork also I give and bequeath unto my son Jaconias Neal one hundred acres of juniper swamp lying on the north side of Long Reach binding on his brother Johns line to them and their heirs for ever And lastly as to all the rest, residue and remainder of my personal estate, goods and chattles, of what kind and nature soever I lend the use of dureing my said wife Mary Neal widowhood to rase my children until they come of age or married and if my said wife should marry then to be equally divided between my said wife Mary Neal and my four beloved daughters, to wit Thankful Neal Trecer (Teresa ?) Neal Clarricy Neal and Hagar Neal to them and their heirs forever and I appoint my beloved wife my executrix and William Banks my executor of this my last will and testament, hereby revokng all former wills by me made in witness whereof I have hereunto set my hand and seal the 27th day of October and in the year of Lord 1790 and in the 15 year of our independance

Personally appeared James Hoskins in court & made oath on the Holy Evangelist of almighty God, that he saw and heard William Neel above named, sign, seal, publish, pronounce, & declare the above instrument of writing to be his last will & testament & at that time he was of sound, disposing mind & memory, and at the same time he saw Thomas Hoskins Senr. & Thomas Hoskins subscribing witnesses, sign their names thereunto & further saith not -

October Session 1792

Ordered that William Banks executor of William Neel deceased bring to next court the orphans of the said Wm. Neel deceased to be dealt with as the court may think proper.

April Session 1793

Ordered that William Neel be bound unto Russell Armstrong until he arrive to the age of twenty one years, and the said R. Armstrong is to learn the boy Wm. Neel {unreadable} the farming business & also to read write & cypher as far as the rule of three.

Ordered that John Neel orphan of William Neel deceased be bound unto William Banks until he arrive to the age of twenty one years and the said William Banks is to learn the boy John Neel aforesaid the farming business & to read, write & cypher as far as the rule of three.

January Session 1794

Ordered that Trecia Neal orphan of William Neal deceased be bound to John Liverman son of William to learn the art & mistrey of a spinster and that said master learn the said orphan to read and wright and the said apprentice is to serve her said master till she arrive to the age of eighteen years.

July Session 1798

Ordered that Russell Armstrong be appointed guardian to William Neal orphan of William Neal deceased and give bond & security in the sum of 500 pounds Thomas Hoskins Senr. and Levi Bateman securities.

October Session 1798

Ordered that Aron Neal guardian to the orphans of William Neal deceased be sited to appear at the next court to render an account of his guardianship to said orphans.

Ordered that Mary Bodwell be allowed fifteen pounds for the support & maintenance of Claricy Neal orphan of William Neal from November 1796 till 12th September 1798 as per account filed.

July Session 1799

Ordered that citation issue against Aron Neil to appear at next court and render an account of his guardianship to the orphans of William Neil.

April Session 1800

Ordered that Hager Neel orphan of Wm. Neel be bound to Dorcas Pool to learn the art and mistery of a seamstress.

January Session 1801

Ordered that Joseph White guardian of Jaconiah Neel orphan of Wm. Neel deceased have leave to sell all the movable estate of the said Jaconiah Neel and make returns to next court.

Ordered that Thomas Hoskins Esqr. be appointed guardian to the heirs of William Neel viz. Hager Neel and hath given bond in the some of five hundred pounds Thomas Hoskins Senr. and Capt. Jesse Alexander securities.

April Session 1801

Ordered that Joseph White & William Alcock be cited to appear to next court to render an account of the property that they have in their hands as former guardians of the heirs of William Neal and deliver the same to Thomas Hoskins Esquire the preasent guardian.

October Session 1801

The audited account of Joseph White guardian of Jakeniah Neel with the estate of Wm. Neel so far as relates to the said Jakeniah was returned in court by Joseph White filed balance due the estate 22 pounds, 8 shillings & 1/2 pence.

April Session 1802

Ordered that citation issue against Aron Neel as guardian of Hager Neel & Clarisa Neel orphans of William Neel deceased together with his security Joseph White & William Alcock to come forward to next court and settle their guardianship with the present guardian.

July Session 1804

Ordered that Darcus Pool be cited to come forward to next court and bring Hager Neel orphan of William Neel deceased before said court.

October Session 1804

Ordered that Hager Neel orphan of William Neel be bound to Mrs. Thankfull Armstrong to live as an apprentice till she arrives to lawfull age and to be taught & educated agreeable to law.

Neal, William, 1791


Summons dated 28 Apr 1795 and issued 22 May 1795 for Robard Sawyer son of Jonathan to answer charges of trespass and damage by Mary Neel executrix of William Neel deceased.

Division of the lands of William Neal deceased to his two sons, Aaron Neal & Wiliam Neal on 16 Nov 1796. Total of 500 acres in Great Alligator, with Aaron Neal plat showing 266 acres. Commissioners were John Clayton, John Armstrong, Joseph Voloway & Russell Armstrong, Surveyor was Woolsey Hathaway and Chain Bearers were James Corhoon son of James and John Corhoon.

Petition April Term 1797 of Therisa Neale an infant under 21 years of age by John Liverman Junr., her guardian, and Clarissa Neale & Hager Neale also infants by Aaron Neale, their next friend appointed by the court. Their father, William Neale died leaving a will dated 27 Oct 1790 which appointed Mary Neale, mother of the petitioners, and Henry Banks as executors. The will provided that upon the death or marriage of their mother, the remainder of the personal estate not specifically bequeathed be equally divided among the wife and four daughters, Thankful Neale, Therisa Neale, Clarissa Neale & Hagar Neale. Their mother has since intermarried with Solomon Bodwell and they now have a right to their distributive shares but they have refused to make distribution and are wasting the estate.

Petition for dower July Term 1797 by Solomon Bodwell requesting that dower be laid out in the lands of William Neale deceased whose widow he has intermarried with.

Guardian bond dated 25 Apr 1797 in the amount of five hundred pounds appointing Aaron Neele guardian of Clarisa Neele orphan of William Neele deceased with William Allcock & Joseph White securities.

Guardian bond dated 26 Jan 1801 in the amount of five hundred pounds appointing Thomas Hoskins Esqr. guardian of Hager Neel orphan of William Neel deceased with Thomas Hoskins Junr. & Jesse Alexander securities.

Guardian bond undated and no amount appointing Joseph White guardian of Jaconiah Neel orphan of William Neel deceased with Timothy Jones & Henry Cullefor securities.
