In the name of God amen: The 17th day of April in the year 1836. I Jeremiah H. Phelps of the County of Tyrrell and State of North Carolina, being in a low state of health in body, but of sound mind and perfect memory, do make this my last Will and Testament, at the same time utterly revoking all former wills made by me, declaring this to be my last will and testament. Viz:
After all my just debts are paid, I give and bequeath to my dearly beloved wife Mary the whole rest and residue of my estate, whether real or personal, and every thing I am possed of whatsoever and wheresoever to her and her disposal: at the same time I do appoint my well beloved wife Mary executrix and two worthy friends i e Abraham Newbery and Hardy Norman both of Washington County joint executors to this my last will and testament to which I have hereunto set my hand and seal the day and date above written.

The last will and testament of Jeremiah H. Phelps was exhibited in open court and proved by the oath of Susan D. Brickhouse who swore that he was of sound & disposing mind; at the same time appeared in open court the executrix Mary Phelps and qualifid to the same the executors therein named refusing.

The entire file of 71 pages consists of documents relating to a suit between Jeremiah H. Phelps as plaintiff and John B. Chesson as defendant in a plea of trespass on the case. A large number of people were summoned to testify. The suit began before the death of Jeremiah and was carried on by his wife and executrix, Mary Phelps.

Tyrrell County marriage bonds show the marriage of Jeremiah Phelps to Marey Hassell on 16 Jan 1820, Alexander M. Dillin security; also Jeremiah Phelps to Fanny Spruill on 24 Jul 1808, Nathan Spruill security. Census records indicate both marriages were to the same Jeremiah Phelps.
Jeremiah Phelps does not appear in the 1820 or 1830 census of Tyrrell County. In the 1810 census he is 26 - 44 and there is a female 26 to 44 and a male 0 - 9.
Jeremiah Phelps appears in the 1820 Washington County Census as 26 - 44, 4 males 0 - 9, 1 male 10 - 15 and no females. In the 1830 census of Washington County Jeremiah Phelps is 50 - 60, 2 males 5 - 10, 2 males 10 - 15, 2 males 15 - 20, 1 female 0 - 5 and 1 female 40 - 50.
