Phelps, Eby, 1836
Bond dated 25 Apr 1836 in the amount of $6,000 appointing Wm. Alfred administrator of the estate of Eby Phelps deceased, H. G. Spruill & Wm. B. Meekins.
Summons dated the 4th Monday in April 1836 for Thomas Dunbar Junr. and wife Betsy and Jos. Halsey guardian ad litem to Ann Caroline Phelps, Rhoda Emeline, Willson, James Anson & Sylvia Phelps to appear at court on the 4th Monday in July next to show cause, if any, why the petition of Nancy Phelps for dower in the lands of her deceased husband, Eby Phelps, should not be assigned to her.
Petition April Term 1836 by Nancy Phelps, widow of Eby Phelps deceased, who shows that William Alfred administered at the present term of this court on the estate of her late husband who died recently possessed of considerable personal property. She prays her years provisions be layed off for her and six infant children now living with her.
Petition April Term 1836 by Wm. Alfred, administrator of Eby Phelps deceased, who prays an order to sell some perishable property belonging to the estate.
Petition April Term 1836 by Nancy Phelps, widow of Eby Phelps deceased, who states that her husband died recently seized and possessed of two tracts of land, one containing 375 acres joining John Haughton, Frederick Liverman and others and the other being 200 acres of swamp joining William Cahoon and others. Petitioner further shows that her husband left as heirs at law the following children, viz. Thomas Dunbar and wife Betsy, late Betsy Phelps, John Phelps, Seth Phelps, of full age, Ann Caroline Phelps, Rhoda Emeline Phelps, Eby Franklin Phelps, William Phelps, James Anson Phelps & Sylvia Phelps. Petitioner prays process against said heirs and Wm. Alfred, administrator of her husband to show cause why she should not be granted dower in these lands.
Bond dated 26 Jul 1836 in the amount of $1,000 appointing William Alfred guardian of William Phelps, orphan of Eby Phelps deceased, Thompson Liverman & George H. Alexander securities.
Petition October Term 1836 by William Alfred, administrator of Eby Phelps deceased, who shows that the debts of his intestate can't be paid and distribution made to his distributees, ten in number, without a sale of the negroes belonging to the estate. He prays an order to sell negroes Sam, Annis, Alfred, Lettice, Cate & Jack.
Court order the 4th Monday in January 1837 for the Sheriff to summon a jury and lay off the dower of Nancy Phelps in the lands of her husband, Eby Phelps.
Laying off of the years allowance to Nancy Phelps, widow of Eby Phelps, on 6 May 1836 by David Cahoon, Thompson Liverman, Abel Cahoon & Chas. McClees.
Laying off of the dower of Nancy Phelps in the lands of her deceased husband, Eby Phelps, on 14 Mar 1837 by John McClees Sheriff and Charles McClees, David Cahoon, Timothy Cahoon, Abel Cahoon, John Cooper, Jesse Sikes, James Davenport, Patrick Liverman, John Jones, Ashbee Liverman, Aden Meekins & Tedrick Liverman. Eby Phelps was seized and possessed of 300 acres on the west side of Great Alligator River in Gum Neck and 100 acres of that was set off to Nancy Phelps joining Tedrick Liverman, William Cahoon & the main road and containing the dwelling and out buildings.
Bond dated 23 Jul 1838 in the amount of $500 appointing Wm. Alfred guardian to Rhoda Caroline, Ann Eliza, Eby Frank & James Anson orphans of Eby Phelps deceased, Charles McClees & Henry E. Lewis securities.
There are many documents in this file dealing with recovery of debts for and against the estate.
Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of Eby Phelps to Nancy Swain on 31 Oct 1827, Lovin Swain security. Since he had adult children at his death, he must have had a previous marriage around 1810.
Tyrrell County marriage bonds also show the marriage of Thos. Dunbar Jr. to Elizabeth Phelps on 17 Aug 1832, John Phelps security.
See the 1821 will of Seth Phelps Senr. Eby Phelps was his son.
