In the name of God amen: I Daniel Roughton of the State of North Carolina and County of Tyrell being weak in body but in sound mind and memory calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament in manner & for following.

I lend to my beloved mother the house and forty acres of land where she now lives during her natural life---

I lend to my beloved wife Elizabeth Roughton the house and plantation whereon I now live containing 105 acres of land be the same more or less during her natural life provided nevertheless that if my wife should want any support for herself therby I empower her to sell all or any part of the land above mentioned for her support and give a deed which shall be as good as valid in law as if I had give the deed in my life time.

I give and bequeath to my beloved daughter Roughton 140 acres of land be the same more or less it being the land and plantation where my mother now lives to her and her heirs forever.

I give and bequeath to my daughter Edney Roughton the land and plantation whereon I now live containing one hundred and five acres be the same more or less at the death of his mother to him and his heirs forever ---

I give and bequeath to my beloved wife Elizabeth Roughton and my daughter Edney Roughton all the remaining part of my estate real and personal with all my household and kitchen furniture also one horse and one mare all my cattle hogs and sheep with all the remaining part of my estate to be equally divided between them at the marriage of my daughter to them and to their heirs forever.

I hereby make my beloved wife Elizabeth Roughton executrix and Henry Alexander Esqr. executor of this my last will and testament and I hereby disallow disanul and revoke all other wills by me made ratifying and confirming this and no other to be my last will and testament given under my hand and seal this eighteenth day of May 1809.

June Session 1809

The last will and testament of Daniel Roughton was proved in open court by the oath of John Swain James Hassell & Isaac Alexander filed.

Mrs. Elizabeth Roughton came into court and quallified executrix to the last will and testament of Daniel Roughton deceased.

Elizabeth Roughton returned in court an inventory of the estate of Daniel Roughton deceased filed.
