I John M. Rolllins of the County of Tyrrell and State of
North Carolina, being of sound and disposing mind and memory do on this fourth
day of May in the year of our Lord, one thousand eight hundred & sixty
(1860) make and publish this my last will and testament, hereby revoaking and
making null & void all other wills and testaments by me heretofore made, and
as to the estate which it has pleased the Almighty to bless me with, both real
personal & mixt of which I shall die seized and possessed or to which I
shall in any wise be entitled at my decease & death, I devise, bequeath and
dispose of in the following manner Viz:
I give and bequeath to my sister Sarah, wife of Edward Mann,
three hundred dollars to his her heirs and assigns forever -
I give and bequeath to my neices Sarah M. Mann, Harriet R. Mann &
Eliza F. Mann children of Edward and Sarah Mann, six hundred
dollars to be equally divided between them, and if either one of them should die
before distributed it is my will that said Legacy of the six hundred dollars,
shall be equally divided between the surviving ones: I give and bequeath to
William A. Rollins Angelica Rollins and Samuel Rollins, infant
children of William A. Rollin, deceased nine hundred dollars to be
equally divided between them, and if either of them should die before the
distribution, it is my will that said Legacy of nine hundred dollars shall be
divided, between the surviving ones:
I give and bequeath to my brother Joseph L. Rollins nine hundred
dollars, to him his heirs and assigns,
I give and bequeath to John R. Cudworth infant son of John H.
Cudworth, six hundred dollars, when he will be at the full age of twenty one
years, and should the said John R. Cudworth die before arriving at the
age of twenty one years, then it is my will that said Legacy of six hundred
dollars should go to and be equally divided between the then surviving
children of my sister Mary M. Cudworth- her by my executors herein after
named. in nine annual
I will and bequeath to my sister Martha Daniel, nine hundred dollars,
to be paid to her by my executors herein after named, in nine annual
installments of one hundred dollars per year.
I give and bequeath to my neice Nancy Cudworth and Llwellen
Cudworth, children of Mary M. Cudworth, three hundred dollars to be
equally divided between them: if either of them should die, then the, (then the)
Legacy shall go to the surviving one.
I give and bequeath to my sister Mary M. Cudworth five dollars to her,
her heirs and assigns forever. I will and devise that my negro man
Fields, aged thirty five years should at my decease be taken by my
executor to the State New York, and there left to "injoye" freedom the
remainder of his days, and for the purpose of enabling them, my executors so to
do, I give and bequeath to them one hundred dollars, all the residue of my
estate not herein bequeathed and named after the payments of all just debts
&c, I will and devise to equally divided between the whole of my lawful
heirs.
Lastly - I nominate and appoint my worthy friend Mr. Thomas R. Mann,
and Samuel E. Mann, executors to my last will and testament. In testimony
whereof, I said John M. Rollins have hereunto set my hand and seal the
day and year first above written.
Signed, Sealed & Published in the presence of we who in the presence of
the testator, and in the presence of each other, and at his request, have
subscribed our names as witnesses hereto

State of North Carolina The foregoing paper writing was exhibited in open court by the executors
therein Named and its due execution by John M. Rollins, as his last will
& testament, was proven by Jacob B. Houck & Joseph B. Mann
the subscribing witness thereto, whereupon it was considered by the court that
it be admitted to probate as as such, and ordered to be recorded whereupon,
Thomas R. Mann and Samuel E. Mann were qualified as executors
thereto by taking the oath of office -
