In the name of God Amen: I Jesse Sanderson of the County of Tyrrel and State of North Carolina being weak in body but of sound mind and memory thanks be to God, do make and ordain this piece or parcel of writing my last will and testament in manner and form as follows.

1st - I desire that all my just debts be paid out of my estate by my executors here after mentioned-

2nd - I desire that my wife Ann Caroline Sanderson be entitled to her part of my personal and chattle property according to the laws of this state, at the expiration of two years from the time of my death. I leave to my wife A. C. Sanderson all of the farm whereon I now live during her natural life and I desire that my executors, have laid off to my wife A. C. Sanderson one years provisions for herself and family -I desire that my executors herafter mentioned shall have full right and authority to sell and dispose of any or all of my lands separate from the land whereon I now live and make to the same if they should think it best for the intrest of my estate and to apply a sufficient sum of the money arising from the sail of said land to finish paying off all my debts after using the amount of the sales of the chattle property and hire of the negroes for two years and the ballance of the money arising from the sale of said lands I desire to be kept by my executors and guardians to my children for the use of my children. All the balance of my propity of any sort or description after paying off my debts and giving to my wife A. C. Sanderson the portion or share due her as mentioned before I desire to be kept by my executors and guardians to my children to be managed in the way or manner that they think best for the intrest of my children untill the oldest one shall arrive at the age of twenty one years then I desire that he or she be entitled to receive their share or part to have and to hold forever -

I desire that each of my children be entitled to receive their or share of the property in the hands of their guardians when they arrive at the age of twenty one years. If either of my daughters get married after they arrive at the age of eighteen years then I desire that they be entitled to receive their part or share of the property but if either of them should get married before they arrive at the age of eighteen years, I desire that they should not be entitled to receive any part or share untill they arrive at the age of twenty one years. If either of my children should live to come to the age of twenty one years or the age described above for them to receive their part or share then I desire that all the property belonging to my estate be equally divided between my two brothers John Sanderson & Thos. L. Sanderson to have and to hold unto them and their heirs forever -If any one or more of my children die before they arrive at the proper age to receive their property I desire that the property in the hands of the executors or guardians to be held for the benefit of the surviving children -

I hereby constitute and appoint my two brothers John Sanderson & Thos. L. Sanderson executors to this my last will and testament and guardian to my children under my hand and seal this the 5th day of January in the year of our Lord 1856.

Then was a paper writing without subscribing witness (to wit this one) purporting to be the last will and testament of Jesse Sanderson deceased exhibited in open court by John Sanderson and Thomas L. Sanderson the executors there in named and it is therefore proven by the oath and examination of John McClees that the said will was found among the valuable papers of the said Jesse Sanderson after his death and the said will is further proved in due form of law so as to pass both real and personal estate. It is therefore considered by the Court that the said paper writing is the last will and testament of the said Jesse Sanderson and same is ordered to be recorded and filed.
