In the name of God amen: 27th March 1809 I Holt Snell of Tyrrell County being very sick and weak in body but in perfect mind and memory thanks be given unto God for the same therfore calling ot mind the mortality of my body and knowing that it is appointed for all men once ot die do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hands of God who gave it and my body I recommend to the earth to be buried in a decent and Christian like manner at the discretion of my executors nothing doubting but at the general resurection I shalll receive the same again by the mighty power of God and as touching such worldly estate as it hath pleased God to bless me with in this life, I give dimise and dispose of in the following manner and form ---

Item - I give and bequeath unto my well beloved cousin Rodger Snell all my right and mesuage of land with one mare by the name of Fan to be freely possessed by him and his heirs forever ---

Item - I give and bequeath to Ase Snell one young mare named Fly and part of my corn.

Item - I give and bequeath to the above Rodger Snell what he is due me for the land where he now lives with one falling G..................

Item - I give unto John Snell son of Roger Snell three head of cattle that is one cow and two yearlings.

Item - I give and bequeath unto my well beloved sister Rosina Alexander since intermarried with some other that I cannot understand who but that makes no odds, I give her ten shillings to her and her heirs forever --- After my worldly debts and funeral charges be paid out of the notes that I hold against Selby Godwin the ballance of the money I give and bequeath unto Asa & Betsey Snell to be equally divided between them.

Item - All the rest of my movable estate I give and bequeath to my friend Rodger Snell before mentioned ot him and his heirs forever. I constitute and appoint and ordain my sole executor and I do hereby utterly disallow revoke and disannl all and every other persons testaments wills legacies and bequeaths ratifying and confirming this and no other to be my last will and testament in witness my hand and here unto set my seal the day and year above written

December Session 1809

A last will and testament of Holt Snell deceased was proved in open court by the oath of Elizabeth Johnston one of the subscribing witnesses and also Joshua Hassell another subscribing witness ordered filed.

Roger Snell came into open court and quallified as executor to the last will and testament of Holt Snell deceased.

Ordered that Roger Snell have leave to sell the moveable estate of Holt Snell and make return to next court.

March Session 1810

Roger Snell returned in court on oath an account of sales of part of the estate of Holt Snell deceased to amount of 23 pounds, 17 shillings & 6 pence.

June Session 1810

Roger Snell returned on oath in court an inventory of the movable estate of Holt Snell deceased filed.

Execution dated 1 Mar 1819 and issued 22 Apr 1819 against Joseph Snell for 11 pounds, 3 shillings & 3 pence for court costs in a suit he lost with Roger Snell executor of Holt Snell deceased. Sheriff's return says nothing to be found to satisfy the execution.

Many other documents relating to a suit in which Joseph Snell is plaintiff and Roger Snell, the executor of Holt Snell, is defendant. One document states that Holt Snell died at the residence of a certain Davenport where Joseph Snell was boarding. Joseph proceeded to shroud the body and make a coffin. Shortly thereafter, Roger Snell appeared with the same intention. Joseph Snell was never reimbursed for his services and that was the apparent genesis of the suit.

There are also various summons and executions against George & Rosanna Moore of Washington County and later Martin County up to 1820. In this suit Roger Snell as executor of Holt Snell is trying to recover value received by George & Rosanna Moore from the will of Holt Snell. {Rosanna is apparently the sister of Holt Snell, the former Rosina Alexander mentioned in the will.}
