Dated 19 January 1878
In the name of God Amen I Azor Snell of the County of Tyrrell in the state of North Carolina being of Sound mind and memory. Considering the uncertainly of life do make ordain and declare this to be my last will and Testament in manner and form following to wit
1st I give and bequeath to my dearly beloved wife Susan fifty dollars in money and one bed and furniture known as her own bed.
2nd I give and bequeath to my Daughter Elizabeth Rhodes one bed and furniture the one I now sleep and five dollars in money.
3rd I give and bequeath to my daughter Cenith Brickhouse five dollars in money and the bed and furniture which she already has in her possession
4th I give and bequeath to my daughter Vesta Merritt five dollars in money and one bid and furniture.
5th I give and bequeath to my grand children. the Children of my daughter Mary Ann that is now dead five dollars to be equally between them, share & share alike.
6th I give and devise to my son John D Snell all my land in Tyrrell County Joining the lands of James Holaway and Heirs of John Tarkenton decd. Containing one hundred acres more or less to have and to hold forever provided he has an heir or heirs born unto him of his body but in case he should die without leaving an heir of his body them it is my will and desire that my land shall be sold and equally divided among all of my heirs and it is understood that my dearly beloved wife Sus has one third part of, my land during her natural life according to law. In witness whereof I the said Azor Snell do hereunto set my hand and seal on this 19th day of January AD 1878.

Signed sealed published and declared by the said Azor Snell to be his last will and testament in the presents of us who at his request and in his presence do subscribe our names as witnesses thereto.

State of North Carolina A paper writing purporting to be the last will and testament of Azor Snell decd. is exhibited before me the undersigned Judge of Probate for the County of Tyrrell by John D. Snell one of the Legatees named therein and the due execution thereof by the said Azor Snell by the oath and examination of James A Holaway and H W Hayman the subscribing witnesses thereto who being duly sworn doth depose and say and each for himself deposoth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Azor Snell. That the said Azor Snell in the presence of these deponants subscribe his name at the end of said paper writing which is now shown as aforesaid and which bore date (?) the 19th day of January 1878. And the deponants further saith that said Azor Snell the testator aforesaid did at the time of subscribing his name as aforesaid declare the paper writing to subscribed by him and exhibited to us to be his last will and testament and this deponant did thereupon subscribe his name at the end of said will as an attesting witness thereto. and at the request of and in the presents of the said testator subscribe his named to the said last will as aforesaid and at the time of the deponants subscribing his name as an attesting witness thereto witness thereto as aforesaid the said Azor Snell was of sound mind and memory of full age to execute a will and was not under any restraint to the knowledge information or belief of this deponant and further these deponents saith not.

To all whom it may concern take notice that I Susan Snell widow of Azor Snell deceased late of Tyrrell County hereby disent from the last will and testament of said Azor Snell Which was made on the 19th day of January 1878 and admitted to Probate on the 14th day of April 1879 hereby claiming the full rights that I would have been entitled to if no will had ever been made. Signed in presence of W C Snell witness this 25th of April 1879.
