Spencer, Martin Byrd, 1835


Bond dated 27 Oct 1835 in the amount of $500 appointing Ephraim H. Powers administrator of the estate of Martin Byrd Spencer deceased, Sally Armstrong, Silby Powers, Harmon Alexander & Hugh Armstrong securities.

Petition October Term 1835 by Ephraim Powers who is administrator of Martin Byrd Spencer as a creditor, said Spencer owing him about $300 by reason of monies paid as surety for him. Petitioner shows there is not sufficient personal property to pay him off and said Spencer died seized of a tract of land, swamp and fishery on the east side of Scuppernong River joining Carney Spencer, D. S. Godfrey & Zebulon Tarkinton deceased. Petitioner further states that Carney Spencer, Hugh Armstrong and wife Sally and William Spencer, a nonresident of this state, are the heirs at law of said Spencer. He prays subpoena issue to said heirs commanding them to appear in court and show cause, if any, why said land, swamp and fishery should not be sold to pay the debt to petitioner.

Summons dated the 4th Monday in October 1836 for Carny Spencer, Hugh Armstrong and wife Sally appear at court on the 4th Monday of January next to show cause, if any, why Ephraim H. Powers, administrator of Bird Spencer, shall not have judgement against the lands of said Spencer and that they be sold.

Audit 26 Jul 1837 of the account of Ephraim H. Powers, administrator of the estate of Martin Byrd Spencer, by Saml. Rogers & Jos. Halsey. They find that the administrator has disbursed to the full amount of the assets with $13.48 due the administrator. Account reflects $261.34 realized from the sale of land and shows many more debts owed by the estate compared to debts owed to the estate.
